It has been twenty-one years since China announced its formal entry into the World Trade Organization in 2001.Looking at the development of the insurance industry in the past 21 years,China has fulfilled its commitment of "high-level,wide-ranging and phased" opening to the insurance industry when it joined the WTO,making the insurance industry the first to open and develop in the financial industry.However,the insurance industry has also exposed many problems that can not be ignored on the way from "rough" development to high-quality development.The low level of protection of insurance consumers’ rights and interests is one of them.The main problems are the lax supervision of insurance regulators,the lack of attention paid by insurance institutions to the protection of consumers’ rights and interests,the serious infringement phenomenon and the poor awareness of insurance consumers’ rights protection.Therefore,in-depth study on the development of China’s insurance consumers’ rights and interests protection level,making the rights and interests protection level specific through quantification,and putting forward suggestions on how to strengthen the protection level of insurance consumers’ rights and interests can effectively promote the development and supplement of China’s Insurance Regulatory theoretical system,which has great practical significance for the stable development of China’s insurance industry and the overall economic development of the country.This thesis sorts out the research results of domestic and foreign scholars on "insurance consumers" and "insurance consumer rights and interests",and determines the research ideas,perspectives and methods of this thesis after referring to the views and research methods of different scholars.First of all,starting from the definition of relevant concepts,this thesis defines and combs the important concepts of insurance consumers and their legitimate rights and interests,and uses three classical theories,namely,consumer sovereignty theory,information asymmetry theory and public interest theory,as the theoretical basis for discussing the rationality,importance and necessity of protecting the legitimate rights and interests of insurance consumers.Then it analyzes the development status of the protection of the rights and interests of insurance consumers in China.Through the introduction of the status quo of insurance consumption complaints,the development of current laws and policies and the status quo of consumer protection work,it is found that the number of insurance consumption complaints in China is growing,laws and regulations need to be supplemented and improved,and consumer protection work needs to be strengthened.Due to the influence of different economic,demographic,cultural and policy factors,the development of insurance consumer protection in China is uneven.In order to clearly and intuitively understand the development gap,this thesis selects 11 provinces as samples,selects 8 development evaluation indicators,and uses the global principal component analysis method to empirically analyze the relevant data from2016 to 2020 to obtain the comprehensive scoring model for measuring the protection level of insurance consumers’ rights and interests and the comprehensive scores of each sample province.Through the analysis of the empirical results,it can be seen that in recent years,the overall protection level of insurance consumers’ rights and interests in China has been continuously improving,but there is a large gap in the development level between provinces,and the development comparison between economically developed and economically backward provinces is obvious.The deep-seated factors affecting the protection level of insurance consumers’ rights and interests are attributed to the formulation of regulations,complaint channels and claim settlement mechanisms.Combined with the analysis results,this thesis puts forward specific suggestions to enhance the protection level of insurance consumers’ rights and interests in China. |
