| With the rapid update and wide application of Internet technology,the sharing economy has emerged and grown rapidly in China.A large number of capital and workers have flooded into the new forms of business,following the rules of general industrial development and pushing the new forms of business to new heights.However,this new mode of the combination of capital and the employee is the existing framework design of labor relations unexpected,and thus led to a series of labor dispute.The labor rights and interests of of new forms of business employees have been repeatedly infringed on the condition that they cannot be relied upon,and the most prominent one is that their social insurance rights and interests are difficult to be implemented.The collection of social insurance is the entrance to the implementation of social insurance rights and interests of workers,and the difficult situation that new types of business employees are included in it exposes the loopholes and backwardness of the social insurance system,intensifies the contradiction between labor and capital,and is also a challenge to social equity and justice.Facing this new subject,the public sector has the obligation to undertake the historical responsibility of updating the system,filling in loopholes and protecting the social insurance rights and interests of workers.In this thesis,on the basis of literature review,the new forms of business employees will attend social insurance question has carried on the questionnaire survey,collects pay for social insurance management is mainly responsible for department of social security and tax departments responsible comrades engaged in relevant work conducted interviews,sums up the current collects pay for new forms of business employees of social insurance management of the difficulty.Due to the rapid development of new types of business,many current social insurance collection management systems have been unable to fully meet the needs of the current era,and the rigidity of labor relations identification system constitutes the fundamental crux of the suffering of social insurance collection management.The skillful means of enterprises taking advantage of the loopholes in the rules and various problems of the social insurance collection and payment management departments have intensified the difficulty of smoothly carrying out the collection for the employees of the new business forms.On the basis of China’s reality,this thesis refers to the beneficial practices of countries and regions in the world where sharing economy is more mature,labor market rules are more sound,social insurance collection management system is more perfect,and system implementation is more efficient,and absorbs the experience and lessons of China’s existing system exploration.Some suggestions and prospects are put forward on how to manage the social insurance collection and payment of the employees of new types of business in China.In the last chapter,this paper innovatively constructed the management method of classified collection and payment of social insurance for employees of new forms of business.Under the circumstance that it is difficult to change the labor relationship identification system,it differentiated the workers with different degrees of dependence on new forms of business by quantitative way,and set up specific collection and payment management methods for different types of workers.The rights and obligations of the government,the new business enterprises and the new business practitioners are determined,in order to solve the root problems in the system.If we want to realize the new vitality of social insurance system,we must have a comprehensive and thorough labor relationship identification system and social insurance system reform in the future.At the same time,this thesis also puts forward corresponding countermeasures for other specific problems existing in the collection management,such as backward information construction,management confusion caused by multi-department participation in the collection,and the lack of awareness of rights protection and ability of employees of new business forms. |
