Implement the criminal policy of combining leniency with severity for minors and the judicial policy of "less arrest,more cautious arrest,more cautious detention".With the specialized handling of cases by the procuratorial organs and the introduction of social work to provide socialized assistance and education to minors involved in crimes,with the joint efforts of judicial social workers,judicial organs,and various parties,the rate of non arrest and non prosecution of minors involved in crimes has significantly increased.A certain proportion of minors involved in crimes are subject to diversion decisions outside the judicial process,and the effectiveness of socialized assistance and education by professional social workers is very significant,And gradually develop towards the direction of building a localized juvenile assistance and education service system.Among them,the People’s Procuratorate of G District in Shenzhen has introduced the judicial social work team of Q institution into the "precision assistance and education" system in Shenzhen,building a "precision assistance and education" service system for juvenile delinquents that is led by the party and government,coordinated by departments,undertaken by society,and participated by all parties.The advanced experience of Shenzhen’s "precise assistance and education" model has leading reference significance for the construction of the assistance and education service system for minors involved in crimes in the country.Therefore,through the opportunity of interning at the People’s Procuratorate of G District in Shenzhen,the author delves into the Shenzhen "precision education" system,learning and exploring the construction and operation process of the overall system.This article is based on the experience of integrating domestic and foreign judicial and social work into the field of juvenile delinquency to carry out the construction of assistance and education service systems;The theoretical framework of the assistance and education service system for minors involved in crimes should include three components: subject,object,and intermediary.The object of the assistance and education service system is the proposer and demander of service needs,the subject is social work institutions and judicial social workers,the object is social minors and party and government agencies with assistance and education service needs,and the intermediary is a bridge and link connecting the subject and object.Taking Shenzhen’s "precision tutoring" system as an example,this article delves into the constituent elements and operational mechanisms of the minors’ tutoring service system.Conduct interviews with frontline judicial social workers,police prosecutors,and minors involved in crimes;Through the internship in the People’s Procuratorate in District G,as a judicial social worker,he participated in the practice of helping and teaching.He collected the material support of this article by using in-depth interviews and participatory observation methods,and used the Ecological systems theory as the theoretical support.In the main part of the paper,he carried out the practice of judicial social work in District G of Shenzhen involved in the "accurate help and teaching" system,taking the judicial process of juvenile criminal cases as the time axis,Taking the practice of judicial social workers in providing assistance and education services as the content of discussion,this article elaborates on the specific content of the "precision assistance and education" system,mainly focusing on three parts:preliminary assistance and education preparation,precise assistance and education development,and follow-up visits in the later stage.The specific practical process is divided into six stages for discussion,and the service process and methods of judicial social workers in carrying out assistance and education practices for minors involved in crimes are summarized,Provide practical guidance for frontline judicial and social workers in China to provide assistance and education services;Through the previous discussion,we attempt to reflect on the overall system of Shenzhen’s "precision assistance and education",and find that it still has shortcomings in terms of assistance and education methods,funding sources,and other aspects.Based on the valuable experience of Shenzhen’s precision assistance and education model,we propose to explore the localization construction path of the juvenile assistance and education service system involved in crimes,and promote the localization development of China’s juvenile assistance and education service system. |
