On May 1,2020,< Regulations on guaranteeing wage payment for migrant workers > is authorized to issue and implement.It is the first time for the Chinese government to enact a law in this field,which can be seen as the sigh of a new era of law-based management.Constitution of China confers the citizens in China the right to get remuneration for work.However,the arrear of wages has been a common phenomenon in engineering construction field for a long time.In the construction production and operation activities,migrant workers engaged in engineering construction work under the management of the employer,but can not get labor remuneration on time and in full,their wages are often delayed.In 2004,the government began to control the wage arrears of migrant workers.Premier Wen put forward we basically solve the problem of arrears in project payments and wages for migrant workers in engineering construction field within three years in < Government Work Report 2004 >.And all the government departments should solve the problem in three years.In 2011,amendment viii to < the Criminal Law > formally criminalized ‘malicious unpaid wages’.As leading sector,according to < Regulations on Supervision of Labor Security > and <Regulations on guaranteeing wage payment for migrant workers >,the administrative department of human resources and social security in Z City constantly enriches supervision means.Before the Spring Festival in 2020,the "two zeros" will be basically realized,that is,the arrears of wages of migrant workers in government-invested projects and state-owned projects will be cleared.However,since the < Regulations on guaranteeing wage payment for migrant workers > has been implemented for one and a half years,the number of complaints about unpaid wages of migrant workers has increased rather than decreased,which indicates that the existing supervision model has not yet reached the requirement of eradicating unpaid wages.In the current situation of extensive management,relatively backward regulatory means and relatively scattered regulatory powers,it is necessary to actively change ideas and expand regulatory means,and create a new mode of wage payment supervision by establishing a multi-level and three-dimensional regulatory system with multi-subject cooperation.With the solid foundation of previous literature review and research,including field investigation and data analysis,the paper fully illustrates the current situation and how Human Resources and Social Security Administrative Department of Z City operate and supervise Migrant workers wage payment.Through the analysis of the regulatory data and typical cases in the past three years,this paper comprehensively analyzes the loopholes in payment supervision,ineffective implementation of regulatory system,weak and inadequate active supervision,and false linkage of supervision.Through the analysis,the reasons of insufficient supervision force,imperfect supervision system,incomplete multi-supervision and unsmooth linkage mechanism are explored.According to the theory of productive government,the paper puts forward the transformation of government functions and realizes the transformation from control government to service government.According to the theory of government supervision and cooperative governance,this paper puts forward to further improve the government joint supervision.Suggestions are given to strengthen capacity building,explore innovative regulatory means,strengthen legislation to improve regulatory systems,strengthen long-term supervision to implement regulatory systems,strengthen diversified supervision to establish collaborative governance mechanisms.According to the governance theory of "One nuclear diversified coordinated governance",the new supervision model of "14533",which is dominated by the government,led by the people and the society,linked by departments and participated by the public,is proposed to provide reference for comprehensively improving the supervision effect of migrant workers’ wage payment in Z City. |
