| With the rapid development of China’s economy,economical and convenient railway travel has become the first choice of people.As the front-line department of railway management and social mediation,railway public security plays an irreplaceable role in the mediation and resolution of social contradictions.However,there are many interfering factors in the application of public security mediation in the practice of railway public security work,which hinders the development of public security mediation.In this paper,literature analysis,investigation and case analysis are adopted to analyze and study H Railway Public Security Office.Based on the experience and effectiveness of H Railway Public Security Office in carrying out public security mediation work,the paper analyzes the shortcomings and difficulties in the existing work.On this basis,it explores the reasons behind the poor public security mediation work.Put forward practical and effective countermeasures.At the present stage,there are many problems in railway public security mediation,such as the police starting public security mediation is tendentious,there are phenomena of expanding or narrowing the scope of mediation at will,there are defects in the process of public security mediation,the effectiveness of public security mediation agreement is not guaranteed,and the mediation results are unreasonable.The problems in H Railway Public Security Office also partly reflect the problems existing in the whole railway public security system in the public security mediation work.Through sorting out and summarizing the above problems,it is found that the main reasons for the above problems are as follows: First,there are vague legal norms on public security mediation at the present stage;Second,railway public security organs have higher procedural requirements for public security mediation;Third,there is a conflict between the voluntary principle of the parties and the discretion of law enforcement.Fourth,the public security mediation agreement lacks legal effect;Fifth,the related supporting mechanism of public security mediation is not perfect.Aiming at the existing dilemma of railway public security mediation,this study puts forward some concrete measures.Firstly,the relevant laws and regulations of public security mediation should be clarified.Second,simplify the procedure of railway security mediation;Thirdly,the legal notification procedure should be added before public security mediation.Fourth,give the public security mediation agreement a certain legal effect;Fifth,we will improve the supporting mechanism for public security mediation.Better development of railway public security mediation is more conducive to protecting people’s travel safety and efficiency,and improving people’s sense of security and happiness,which is also the inevitable direction of the development of China under the rule of law. |
