Research On The Optimization Of Civil Dispute Resolution "The Connection Between Public Security Mediation And People’s Mediation"

In recent years,cases of serious injury and death caused by civil conversion to criminal cases and mass incidents have become a major factor affecting social stability,which has attracted widespread attention from all walks of life,and the resolution of civil disputes,the source of these two incidents,has also become a hot topic in theoretical and practical discussions.Traditional people’s mediation is not uniform and standardized in the application of mediation rules,resulting in obvious differences in mediation results,resulting in the fairness of people’s mediation often questioned by the outside world.However,public security mediation is limited by the lack of police resources and professional mediation capabilities,and the results of mediation work are not obvious.How to give full play to multiple forces to effectively resolve civil disputes has become an important theoretical and practical issue.In 2003,Jiangsu Province took the lead in establishing a grand mediation mechanism of "party and government leadership,political and legal leadership,judicial first,and participation of all parties",which achieved good results in practice.However,it has been 19 years since the establishment of the police-dispatch linkage mechanism in 2003,and there is not much research literature on police-dispatch linkage,especially the empirical research on the police-dispatch linkage mechanism.How to truly respond to practical and theoretical problems,and how to continuously optimize the mechanism to better achieve the requirements of resolving civil disputes,needs to be continuously explored.Under the influence of the "Fengqiao experience" in Zhejiang Province,T City has an advanced people’s mediation foundation,the problem of civil disputes has been prominent in recent years,and it has been eight years since the police investigation linkage mechanism has been carried out,and has good practical research conditions.Based on the experience and current situation of T City,Zhejiang Province over the years,this paper summarizes historical experience,combines the theory of collaborative governance and holistic governance,takes T City,Zhejiang Province as the research object,selects a number of representative police stations,focuses on the use of interview survey method and questionnaire survey method,cooperates with literature research method and case analysis method to carry out research,and investigates the application of the "police investigation connection" mechanism in practical work.Based on the research materials,this paper summarizes the advanced experience of mediation work in rural areas and communities,the establishment of judicial confirmation docking centers,and multi-level multi-layer multi-linkage mediation mechanisms.It summarizes the problems in many aspects,such as inadequate guarantees,uneven development,unsmooth work,and irregular systems,and the main reasons for this are that in terms of system and management,the police transfer linkage mechanism is not perfect,and there is a lack of unified leadership.At the same time,in view of the reasons for these problems,fundamental suggestions were put forward to enhance the guarantee of funds and personnel,improve the work system,optimize departmental coordination,and also put forward forward-looking suggestions such as ensuring the implementation of mediation agreements and strengthening the construction of digital technology mediation platforms.Through the investigation of the actual operation of the "police investigation connection" mechanism in T City,on the one hand,the author collects practical materials for relevant scholars and policy researchers,on the other hand,the author tries to combine the research situation with theory to provide constructive suggestions for the implementation and development of the "police investigation connection" mechanism,promote the optimization of the "police investigation connection" mechanism,realize the function of efficiently resolving civil disputes,and escort the stable and orderly development of society.
