Legal Protection Of Data From The Perspective Of Blockchain Technology

Blockchain technology has grown rapidly in recent years and is seen as a disruptive technology.As the core content of blockchain technology,the legal protection of data is a prerequisite for the development of blockchain technology.On the one hand,the architecture of blockchain technology has improved the level of the legal protection of data;on the other hand,its technical characteristics have created great challenges to the legal protection of data.This paper examines the legal protection of blockchain data from the perspective of blockchain technology.In this paper,the platform basis and legal protection of data on the chain and other related concepts are elaborated.In the face of the two sides of technology,the paper briefly analyzes the protection function of blockchain technology to data on the chain.Then it focuses on the challenge of blockchain technology to the legal protection of data on the chain.Through the discussion of the specific content of the challenge,further analysis of its causes,and putting forward the corresponding legal measures,our country can be prepared in the face of the above challenges.The structure of this paper is divided into six parts:The first part mainly explains the source of the topic,the purpose,and the significance of the research,and introduces the research status of data legal protection from the perspective of blockchain technology at home and abroad.After that,the important concepts involved in this paper are defined.Finally,the main research methods and innovation points of this paper are sorted out and explained.The second part,from the perspective of blockchain technology,elaborates on related concepts of blockchain technology and legal protection of data on the chain and summarizes the protection functions of blockchain technology for data on the chain from different technical architectures.The third part mainly starts from the Angle of the characteristics of blockchain technology and analyzes its challenges to the legal protection of data on the chain.Its characteristics include immobility,anonymity,decentralization,and integrity.The fourth part mainly analyzes the causes of the challenges mentioned in the previous part,including the abstraction of data protection norms,the imbalance between blockchain technology innovation and legal regulations,and the incompatibility of blockchain technology and legal norms.The fifth part,based on the characteristics of blockchain technology’s challenges to on-chain data protection,proposes legal countermeasures such as improving the way to realize rights,clarifying the content of legal liability,and innovating the traditional supervision mode.In the sixth part,by sorting out the structure of the full text,the author puts forward the prospect of further research on the legal protection of data on the chain in the future and points out some shortcomings of this paper.
