As a data information delivery technology with the main characteristics of non replicability,non tampering,decentralization,de trust,asymmetric encryption and time stamp,blockchain is extremely consistent with the judicial justice and judicial trust pursuit in the current judicial operation of our country.From Shenzhen’s first proposal of the world’s first real application of blockchain in the judicial field-"blockchain +judicial application" arbitration chain,to Beijing Internet court’s construction of"Tianping chain" based on blockchain in 2019,to Hangzhou Internet court’s first launch of "judicial blockchain" platform In just a few years,blockchain technology has been widely applied to solve judicial problems in China.Especially in the earliest judicial application of blockchain,blockchain technology has made great achievements in the construction of electronic data deposit to lead the advanced development of third-party blockchain deposit.However,in the process of combining with civil justice,some problems still can not be avoided.This is the inevitable result of the integration of traditional civil justice and modern emerging technology,and it is a macro trend Large and complex issues,whether in theory or in practice,are not mature in China,especially when the blockchain technology enters the legislative and judicial process.There are many problems to be solved in the judicial blockchain platform of Hangzhou Internet court.Among them,there are the following existing problems: 1.The judicial blockchain is too fast,which leads to the lag of laws and regulations;2.The judicial jurisdiction is vague;3.The judicial blockchain evidence review caused by the nonstandard blockchain technology and storage platform;4 However,after the "skeleton" is built,the "blood" filling problem will be solved.Therefore,a series of normative measures for judicial blockchain must be put on the agenda as soon as possible.These problems are extremely important and should be paid attention to in the operation process of judicial blockchain,because it will directly affect the innovation speed of the entire legal system.If we can’t comprehensively examine the existing problems of the combination of blockchain technology and justice from a dynamic and systematic perspective,then blockchain technology,whether with judicial or other innovation and integration,will be the next step on the development road This is an insurmountable obstacle.Therefore,this paper discusses and studies the problems existing in the combination of blockchain and civil justice,and puts forward effective solutions,which may bring us a test field where blockchain technology and civil justice collide and promote each other.In addition to the introduction and conclusion,this paper is divided into three parts.The first part: the basic theory of blockchain civil justice.This part first introduces the concept of "blockchain" and "judicial blockchain",analyzes its basic situation,analyzes the characteristics of judicial blockchain,lists three different types of blockchain modes,analyzes the impact of blockchain on civil justice,combs the necessity of the combination of blockchain and civil justice,and provides theoretical support for the later research.The second part: starting from the first case of Hangzhou Internet court online adjudication judicial blockchain intelligent contract technology applied in civil procedure,analyzes the problems exposed in practical cases,and leads to the application status and existing problems of judicial blockchain: 1.The lag of laws and regulations;2.The ambiguity of jurisdiction;3.Based on blockchain technology At present,the state is committed to promoting the implementation of judicial alliance chain.The third part: the improvement and development of blockchain civil justice.In the face of the problems reflected in the second part,this paper puts forward various complementary measures to standardize the process: targeted and comprehensive improvement of laws and regulations,taking reasonable methods to regulate jurisdiction,clarifying the focus of judicial review of blockchain evidence,and promoting the implementation of alliance chain.Through the above ideas,we hope to provide new ideas and Countermeasures for China’s judicial blockchain.
