Research On The Issue Of Community Correction Procuratorial Supervision

At present,the community correction,a kind of non-imprisonment punishment introduced from outside the country,has been piloted and implemented in China for18 years.Its development is also one of the important symbols of China’s social management toward modernization and innovation.In a sense,procuratorial organs also belong to the broad sense of social management subject,and their law enforcement and case handling activities can also be understood as a social management activity.Secondly,as an important legal supervision organ,the real-time or dynamic supervision carried out by the procuratorial organ with the power of procuratorial supervision is also a process in which the procuratorial organ takes advantage of the identity of the supervisor to participate in social management and generate positive feedback.The innovation of social correction supervision mode of procuratorial organs is the manifestation of the mission of procuratorial organs to shoulder their own social management.Viewed from the power source of constitution,it is also a kind of value shape of procuratorial power for civil society.Based on the research background,with a strong sense of problems as the guidance,through the "status quo-problems found-reason analysis-perfect Suggestions" the logic of the guidance,sample parts of the investigation has carried on the survey and empirical research,from the current situation of local exploration of the current our country community correction of the procuratorial supervision and operation of various evils at the grassroots level,and gives constructive reply.Considering the scale of community prisoners and the scale of procuratorial institutions,this paper selects Xinzhou District of Wuhan City,Hubei Province,where the author’s hometown is located,as the object of investigation.By means of investigation,interviews,interviews,empirical statistics and other methods,some problems predicted by the author in the field of procuratorial supervision are explored and studied in a more targeted way.The author finds that there are three major problems in the procuratorial supervision of community correction at the present stage:1.System construction,including legal norms,institutional Settings and staffing;2.2.Mechanism operation issues,including the form of supervision,supervision means,and coordination between institutions;3.Standards and norms of supervision.Correspondingly,the author tries to systematically and deeply explore the causes of the problem from the above three problems,First,innovate the concept of inspection and supervision,take "flexible supervision" as the work guide,and promote the system construction of procuratorial supervision by taking the reform of internal institutions and posts of prosecutors as the opportunity;Second,multi-mechanism linkage,rich supervision means,take the construction of intelligent procuratorial as an opportunity to innovate the construction of procuratorial supervision mechanism;Third,through the study and formulation of the "People’s Procuratorate Community Correction Procuratorial Measures" and other supporting judicial interpretations to unify the work standards of procuratorial supervision.
