Research On The Operation Of Community Correction System

Community correction system,a kind of imprisonment penalty system,is a qualified perform the sentence on the criminal in the community in the open,making full use of favorable social resources,to their ideological education reform and a method of behavior modification.Community correction system is a major reform of the penal system,marking the punishment by imprisonment penalty to non imprisonment penalty;the penalty is a product of human civilization to humanity,mitigation and social evolution.In January 2012,the Supreme Court,the supreme,the ministry of public security,the ministry of justice jointly promulgated the measures for the implementation of community correction marks the community correction work in our country entered a trajectory of institutionalization and standardization.After ten years of exploration and development,China’s community correction work comprehensively,has made some achievements and experience,but is still in the initial stage of the development of community correction,compared with the mature foreign community correction idea and system,there is still a big gap,to the development of the road is still long.Therefore,it is very urgent and necessary to improve the work of community correction in our country.Nowadays,the study of community correction system mostly stay in the research and its meaning,characteristics,advantages and disadvantages,the theoretical basis and theoretical level,and in the process of community correction in the actual operation problems,difficulties,focusing on issues such as the development direction of study is less,theory of community correction should not be utopian socialism,but should be combined with practice,to achieve further perfect and development.This article is based on the author of grassroots community correction work,the overall status of community correction practice as a study case,by conducting research field visits,the integrated use of case analysis and empirical analysis,from the empirical perspective to explore the problems restricting the development of community correction system further and chains,perfected and developed to improve the system of correction and advice as follows:This article is divided into five parts.The first part is the introduction.The author simply introduces the selected topic background,research significance,research status at home and abroad and the articles of research ideas,research methods,innovations and deficiencies.The second part of the community correction system theory analysis.This part explains the concept of community correction,combing the origin and development process of community correction system,to explain the characteristics of community correction and the theoretical basis,the community correction system to do a simple basic introduction,clarify the development of community correction,this paper theoretically the particularity and necessity of community correction.The third part is the present situation in the construction of community correction of Feicheng.This part of the research by conduct field visits,grasp the status of community correction,including institutions and correction system construction,team construction and infrastructure construction;This paper introduces the measures and the implementation of community correction.Through interviews correction workers,community inmates and the masses,the community correction of problems and difficulties have a more detailed understanding,found that the problem,find the reasons and countermeasures for the next step of analysis.The fourth part of the Feicheng city community correction work present situation,to explore the problems of community correction in Feicheng city.The existing problems are summarized in five aspects:legislation on community correction legislation is not perfect,the current law lacks of operation,applicable object narrow issues of community correction;community correction of the existing lack of strength,low degree of specialization of work mechanism,the lack of coercive measures,corrective measures of a single,lack of financial security problems,functional departments there is convergence mechanism of information sharing obstacles,social investigation and assessment of useless,remote execution is difficult,imprisoned execution of difficult problems;the cultural concepts exist severe thought seriously,lack of social identity,community development is not mature,the correction publicity is not in place;there is a lack of specialized juvenile correctional law and personnel organization minors and the personalized correction project the problem of the lack of juvenile community corrections.In the fifth part,the author combines the advanced theory and experience of domestic and foreign countries,aiming at the problems existing in the current community correction system,and makes some countermeasures for the further development and improvement of the community correction system.Mainly include:improve laws and regulations,build a complete community correction mechanism,establish a linkage mechanism,improve the community correction system,such as the five aspects of the community correction.
