| Property punishment in the criminal cases of sentencing process as an additional punishment,to deter criminals,fighting corruption crimes have unique effect,procuratorial organs to each kind of penalty enforcement activities implementation of legal supervision,property punishment,of course,is no exception,but currently in the process of property penalty execution of procuratorial supervision,exposed many problems,how to effectively deal with defects in the process of property penalty execution and improve the level of property penalty execution,to improve their ability of procuratorial supervision has become an important subject to be faced with.At present,the separation of criminal trial organs and penalty execution organs in China leads to the fact that penalty execution and effective criminal judgment cannot maintain a high degree of consistency,which is not conducive to maintaining China’s legal authority and reducing the credibility of the law.Therefore,it is necessary to strengthen the procuratorial supervision of penalty execution by procuratorial organs to ensure the authority of criminal judgment.This article from the perspective of perfecting the property punishment execution of procuratorial supervision,a brief overview of the property punishment,property punishment execution of our country’s execution and property of the procuratorial supervision,this paper discusses the property punishment execution object,content and the necessity of procuratorial supervision,and property in our country’s execution of the reality of the existence of procuratorial supervision system,based on the analysis of the problems and reasons,from strengthening the concept of property penalty execution procuratorial supervision,perfecting the property penalty execution and the procuratorial supervision and legislation,establish and improve the property penalty execution of procuratorial supervision and guarantee mechanism,and establishing and perfecting the property punishment execution procuratorial supervision mechanism are proposed,In order to look forward to improving our country’s property execution of the procuratorial supervision system. |
