In recent years,video surveillance systems in public places have been widely constructed and deeply applied.In real life,video surveillance is used in a large number of constructions,playing an important role in maintaining public safety and improving governance efficiency.In addition to this,many social actors have also installed a large number of video surveillance.The large-scale construction of video surveillance in public places has infringed on the personal rights and interests of citizens.The first part of this paper puts forward the problems arising from the installation and use of video surveillance in public places: First,the definition of the scope of video surveillance installation in public places is not clear enough.Second,how to improve the supervision of video surveillance data in public places.Third,how to crack the infringement problem of video surveillance in public places.The second part discusses the connotation of public places and the development of video surveillance systems in public places,and sorts out the current legislative status and characteristics related to video surveillance in public places in China.The third part first analyzes the rationality of the existence of video surveillance system,briefly expounds the super panoramic prison theory,analyzes the conflict between citizens’ demands for security,privacy rights and personal freedom,and analyzes how to balance the conflict between the use of video surveillance system and citizens’ rights.In order to effectively solve the above problems,the author puts forward relevant regulatory suggestions in Part IV.Firstly,the principle to be followed in limiting the installation scope is proposed,and when clarifying the installation scope of video surveillance,a compromise legislative model should be adopted,which not only has the advantages of enumeration and generalization,but also makes up for the shortcomings of only using a single mode.Secondly,different suggestions are put forward on the construction procedures of different installation entities,and the construction of government departments needs to be evaluated and demonstrated,and the construction of social entities needs to be approved and filed by the public security organs.Finally,the relevant ways for state organs,video surveillance equipment managers or owners,and individual citizens to use video surveillance data are discussed,and the storage and destruction period of video surveillance data is clarified. |
