Research On Public Video Surveillance And Citizens’ Privacy Protection In The Era Of Big Data

In recent years,the number of public video surveillance has grown rapidly around the world,and surveillance cameras can be seen everywhere in the streets and public places.However,public video surveillance also has its advantages and disadvantages: on the one hand,public video surveillance has important functions of maintaining public security and public management;on the other hand,the use of public video surveillance poses great challenges to the protection of citizens‘privacy,especially the combination of public video surveillance and big data technology.Information collection and information analysis capabilities have been continuously being improved through automated data processing technology.People’s casual movements,expressions,and travelling in public places will be recorded or even retained for a long time.Moreover more new personal privacy and personal information can be explored through the analysis and integration of big data technology.The lack of management of these information and the lack of regulation of public video surveillance behavior will easily lead to the infringement of citizens’ privacy.On this basis,the general public and academic circles are paying more and more attention to the discussion of privacy rights in public places and how to strike a balance between the application of technological governance and the protection of privacy rights.In this paper,it will be expounded from the following five aspects focusing on the discussion of privacy rights in public places:The first part is the overview of public video surveillance in the age of big data.It is analyzed from three aspects: firstly,the definition of public video surveillance,mainly introducing the concept of public video surveillance,the difference between public video surveillance and public video surveillance systems,and the definition of public video surveillance mentioned in this chapter;secondly,the current development situation of the close combination of public video surveillance and big data technology;thirdly,the introduction of the use characteristics of public video surveillance in the age of big data.The second part is the overview of privacy rights in public places.Firstly,the concept of privacy rights is comprehensively explained from three aspects: spatial privacy right,peaceful right of private life,and secret right of private life.Secondly,the connotation of public places and the particularity of the current "public" are clarified to pave the way for the justification of privacy rights in public places.Finally,the existence of privacy rights in public places is proved from the theoretical and practical perspectives.The third part is about the conflict between public video surveillance and the protection of citizens’ privacy rights in the age of big data.Starting from the current infringement and infringement characteristics of citizens’ privacy rights caused by public video surveillance,the value conflicts and related causes of conflicts between public video surveillance and privacy protection are analyzed to pave way for finding a solution to balance the conflicts between the two.The fourth part is about the current situation of protection of privacy rights in the age of big data in China.As personal privacy is related to personal information,firstly,the connection and difference between the two under the background of the "Civil Code" are analyzed,and then the current situation and shortcomings of the protection of personal privacy and personal information from the perspectives of public law and private law are analyzed.The fifth part is about the construction of privacy protection system in the age of big data.It is expounded from the four aspects of administrative ethics adhered to by technological governance,perfection of legislative system,formulation of unified public video surveillance use and operation specifications,establishment and improvement of accountability and relief mechanisms.Finally,some humble opinions are put forward.
