Research On The Problems Of Local Legislation Filing And Review System

Local legislation is an important part of China’s legal system and an important supplement to national legislation.China’s local filing review system is an important system for legislative supervision at the local level,and it is also an important part of China’s full-coverage filing review system.In the report of the 20 th National Congress of the Communist Party of China,it was further emphasized that improving and strengthening the filing and review system plays an indispensable role in promoting the improvement of local legislation.Since the filing review system has a process from initial establishment to gradual improvement and development,this paper selects to list typical cases of filing review,detailed provisions issued by different regions on the local filing review system,and the filing data submitted by the Ministry of Justice to summarize,compare and analyze the basic concepts,meanings and functions of the local filing review system,find out the shortcomings of the current system,and analyze the causes of the problems.Seek to give improvement suggestions from the perspectives of optimizing relevant procedures,broadening review standards,improving relevant mechanisms,and ensuring the supply of human resources.In addition to the introduction and epilogue,it is divided into four chapters.Chapter 1 briefly summarizes the development history of the filing review system,defines the remaining relevant concepts of the system and explains the functions of the system.Chapter II starts with the implementation process and feedback of the filing review system and the actual situation of each local filing review,and analyzes the specific review methods and typical cases according to different initiation methods.Chapter III summarizes the difficulties and deficiencies faced by the filing and review system in the operation at this stage,and discusses the review procedures,review principles,review awareness and ability,and error correction mechanisms.Chapter IV aims to further improve the filing and review system by introducing good laws and element evaluation methods as review and evaluation standards,establishing accountability and assessment systems,and establishing local special review systems,and implementing the requirements of "everything necessary,all preparations must be reviewed,and mistakes must be corrected".
