The Study On The Filing And Review On Administrative Normative Documents Within Local Administrative System

The 19 th National Congress clearly proposed to speed up the improvement of China's legislative system to ensure the effective implementation of the rights and interests of citizens.As an administrative normative document at the end of China's legal system,because of its huge quantity and tangible influence,it is closer to the daily life of the people.However,the shortcomings of the administrative normative documents and the defects of the supervision system have caused the people to suffer from it.Therefore,how to scientifically and effectively regulate administrative normative documents has become an important issue for China to realize the rule of law in China.At present,the supervision methods of administrative normative documents mainly include administrative agency filing review,administrative reconsideration of the National People's Congress,and incidental review of administrative litigation.Among them,the administrative agency's filing review is not optimistic about the academic circle because of its own defects,but it plays an important and irreplaceable role in the supervision of administrative normative documents.The administrative agency's filing review system has a space to explore,and how to strengthen the construction of the administrative agency's filing review system are all worthy of study.Due to the complexity of administrative normative documents in various provinces,it is appropriate to use the text of the filing review of provincial administrative normative documents as the research object.The administrative filing review system can be examined and analyzed from three aspects: filing,review and accountability.The system itself has some defects such as poor legislative operation,weak public participation and lack of accountability mechanism.In order to improve the administrative filing review system of administrative normative documents,it can improve the maneuverability of administrative legislation,increase public participation and science.Implement the responsibility investigation mechanism to implement these aspects.On this basis,give full play to the advantages of the administrative filing review system,overcome its own shortcomings,and establish a scientific,effective and coordinated administrative filing review system to obtain the best supervision effect.
