Research On The Filing And Review System Of Local Normative Document

The filing and examination system is a constitutional system to ensure the execution of orders and prohibitions by the CPC Central Committee,guarantee the implementation of the Constitution and laws,protect the legitimate rights and interests of the people,and safeguard the unity of the national legal system.At present,China is in an important period of socialist rule of law construction.In order to further promote the strategy of comprehensively governing the country by law,the CPC Central Committee with Comrade Xi Jinping as the core has made important decisions and arrangements on the filing and review system for many times.In recent years,the local people’s congress and its standing committee in accordance with the party central committee’s decision to deploy,and actively improve the record review system and working mechanism,promote the record review information construction,to strengthen the record review theoretical research,the development in all aspects of new practice exploration,a breakthrough,but because of local regulatory documents for the record review system to establish the time is not long,all aspects are not mature,and there is still room for improvement in its practice.Based on the local regulatory documents for the record review system as the research object,with local regulatory documents for the record review situation as the research content,combined with the record review frontier theory in-depth analysis of the shortcomings of the system and the difficulties in the development,then analyses the reason of output of these problems,and from aspects of the content,improve the system security system operation suggestions for improvement are given.This paper consists of three parts: introduction,text and conclusion.The text is divided into five chapters: The first chapter starts with the concept and scope of local normative documents,and discusses the development context and research value of local normative documents filing and review system;The second chapter analyzes the theoretical basis of the system of filing and reviewing local normative documents from the two aspects of legislative supervision theory and people’s Congress system theory,and discusses the necessity and inevitability of the development of the system in China;The third chapter examines the implementation of the archival filing and review of local normative documents in China,sorts out the differences between the laws and regulations on archival filing and review of provincial normative documents in China realistically,and focuses on the achievements and problems encountered in the implementation of the system of archival filing and review of local normative documents in Qinghai Province,it shows the differences in the construction and cognition of filing examination system among different provinces in China;The fourth chapter analyzes the operation of the system of archival filing and examination of local normative documents in China from the aspects of archival filing and examination standards,archival filing and examination procedures and institutional safeguard measures,and summarizes the causes of the above problems;The fifth chapter puts forward solutions to the problems in the current operation of China’s local normative document filing and review system and suggestions for further improvement,including refining the review standard,optimizing the filing and review procedure and strengthening institutional safeguard measures.
