Research On The Legal Issues Of Rural Pension Mode Selection In China

With the increase of the number of elderly population in China,the degree of aging is deepening,and the problem of aging society in rural areas is becoming more and more serious.As rural young people enter urban development and family structure changes,relying on the family pension model has been unable to meet the needs of the elderly in rural areas.In this context,it is of great significance to explore a diversified pension model suitable for rural old-age care to protect the old-age rights and interests of rural elderly.Through the study of the changes and current situation of China’s rural elderly care model,it is found that the current rural elderly care model in China has problems that are inappropriate for the development of rural elderly care;and the corresponding analysis of the causes of the problems that exist at this stage,such as the unbalanced development of the rural in-home elderly care model in different regions,the poor promotion and implementation of the rural mutual help elderly care model,and the difficulty of sustaining the rural institutional elderly care model and the difficulty of placement after the termination of services.The theoretical basis is elaborated from two aspects: the government-led principle and the theory of citizens’ right to old age,providing theoretical support for the choice of China’s rural old age model;at the same time,through the introduction of the overseas old age models of the United Kingdom,the United States and Japan,based on China’s national conditions,the inspiration for China is summarized;From the perspective of the different levels of economic development,the proposal for the selection of China’s rural retirement model is improved: it is proposed that rural areas in less developed regions choose to focus on the home-based retirement model and introduce mutual help retirement services;rural areas in developed regions develop a combination of home-based and institutional retirement model according to their own situation,and the proposal for the improvement of the rural retirement model in less developed regions and developed regions.Improving the choice of China’s rural retirement model from the perspective of different levels of economic development can further improve the protection of the rights and interests of the elderly in their old age.By studying the problems of current rural retirement models and promoting the selection of suitable retirement models in rural areas at different levels of economic development in China,it is conducive to promoting the development of diversified retirement models and achieving a balance between the rights and interests of the elderly in rural areas and the public interests of society,which is the right thing to do to promote the development of the elderly in China.
