| The formal implementation of the Law on Legal Aid on January 1,2022 makes the legal aid system not only face the problem of systematic construction based on the new legal aid system,but also need to be further improved on the basis of the original legal aid system.Based on the analysis of the current situation of the construction of the legal aid system in the three poverty-relief counties in Chang zhi City of our province,this paper makes data statistics on the construction of the legal aid institution platform system,the implementation system,the security system,the supervision system,and the evaluation system.Through questionnaires and in-depth interviews with legal aid personnel,aid objects,public legal service managers,and the public,it is found that in the nearly 20 years since the implementation of the Legal Aid Regulations,While the construction of legal aid system in poverty-relief counties and districts has made great progress,there are serious deficiencies in the construction quality.Therefore,aiming at the high-quality construction of the legal aid system,we should comprehensively improve and perfect the legal aid system in poverty-relief counties.The full text is divided into three parts.The first part takes three poverty alleviation counties in Chang z hi City as analysis samples,and systematically analyzes the current situation of the construction of legal aid platform system,implementation system,security system,supervision system,and evaluation system in poverty alleviation counties based on investigation and research.The second part mainly focuses on the problems and causes of the construction of the legal aid system in poverty alleviation counties and districts.It was found that the construction of the legal aid entity platform system is incomplete,the legal aid implementation system is incomplete,the legal aid guarantee system is not in place,the legal aid supervision system is not in place,and the legal aid evaluation system is basically lacking;The reasons for the problems in the construction of the legal aid system in counties and districts that are under poverty alleviation include: lack of awareness and lack of standardization among legal aid subjects,unclear and unreasonable assistance needs of legal aid recipients,poor linkage of legal aid mechanisms,single legal aid methods,and serious insufficient government guarantees for legal aid.In the third part,aiming at the existing problems in the construction of legal aid system in poverty relief counties,the author proposes and demonstrates the basic countermeasures for improving the legal aid system in counties and districts that lack poverty relief,namely,improving the three platform systems of legal aid in poverty relief counties and districts,and improving the digital and intellectual level of legal aid;Secondly,improve the implementation system of legal aid in poverty alleviation counties and districts,and improve the standardization and standardization of legal aid;Third,improve the legal aid guarantee system in poverty alleviation counties and regions,and form a coordinated legal aid guarantee mechanism with main and auxiliary functions;Fourth,improve the legal aid supervision system in poverty alleviation counties and districts,and establish comprehensive legal aid supervision measures throughout the process;Fifth,improve the evaluation system of legal aid in poverty alleviation counties and regions,and establish dynamic and diverse evaluation methods and standards for legal aid. |
