The promulgation of the Law on Legal Aid not only makes the existing legal aid system established in accordance with the Law on Legal Aid need to be further improved,but also urgently needs to build a comprehensive and systematic new legal aid system that is compatible with the Law on Legal Aid.Therefore,it is of great practical value to put forward and demonstrate the basic countermeasures to improve the legal aid system in underdeveloped counties and districts by investigating and studying the current situation of the construction of the existing legal aid system,especially in underdeveloped counties and districts,clarifying the outstanding problems in the construction of the legal aid system in underdeveloped counties and districts,exploring and analyzing the deep-seated reasons for the problems.From the macro perspective of improving the legal aid system in underdeveloped counties and districts,based on the field survey data samples of the construction of the legal aid system in eight underdeveloped counties and districts,this paper starts with the empirical analysis of the current situation of the construction of the legal aid system in underdeveloped counties and districts,and then analyzes the outstanding problems and causes of the construction of the legal aid system in underdeveloped counties and districts,and finally proposes and demonstrates the basic path to improve the legal aid system in underdeveloped counties and districts.The full text is divided into three parts.The first part is based on the actual situation of the construction of the legal aid system in the underdeveloped counties and districts,and uses the empirical research method to analyze and study the current situation of the construction of the legal aid system in the underdeveloped counties and districts.It mainly analyzes and studies the personnel system,three major platform construction systems,implementation system,supervision system,security system and evaluation system of legal aid institutions in underdeveloped counties and districts.The second part,based on the analysis of the current situation of the underdeveloped counties and districts,further analyzes and discusses the outstanding problems that still exist in the construction of the legal aid system in the underdeveloped counties and districts,such as the unbalanced construction of the aid organization system,the unsmooth connection of the platform system,the lack of operability of the implementation system,the single supervision system,the imperfect security system,and the lack of the evaluation system.And in-depth analysis of the five reasons for the problems in the construction of the legal aid system in the underdeveloped counties and districts,namely,the low financial revenue and limited special funds for legal aid in the underdeveloped counties and districts,the serious shortage of professional talents and the difficulty in talent introduction,the inadequate publicity of legal aid and the unclear needs of the public for assistance,the lack of institutionalized guarantee mechanism for the legal aid system,and the lack of a government-led,sector-society coordinated legal aid system mechanism.In the third part,aiming at the problems and reasons in the construction of the legal aid system in underdeveloped counties and districts,the author proposes to build a legal aid personnel organization system with comprehensive coverage,balanced allocation and orderly operation in underdeveloped counties and districts;We will improve the legal aid platform system in underdeveloped counties and improve the level of digital and intelligent legal aid;Improve the implementation system of legal aid in underdeveloped counties and districts,promote the standardization and standardization of legal aid,improve the legal aid guarantee system in underdeveloped counties and districts,and establish a diversified guarantee mechanism;Improve the supervision system of legal aid in underdeveloped counties and improve the quality and efficiency of legal aid;We should improve the assessment and evaluation system of legal aid in underdeveloped counties and establish effective incentive and restraint mechanisms. |
