Study On The Governance Of Telecom Industry Combat Telecom And Online Fraud In Shanxi Province

In recent years,the telecom network fraud has become the crime type with the largest number and fastest increase of cases,and the strongest response from the people,which seriously endangers the vital interests of the people and affects the social harmony and stability.The telecom network fraud is inseparable from the use of communications,and the telecom industry naturally undertakes the tasks of source governance,monitoring and tracing,and cooperation in combating this crime.Strengthening the governance capacity of the telecom industry is of great significance for winning the protracted war against the fraud and safeguarding the vital interests and property security of the people.Law of the People’s Republic of China on Combating Telecom and Online Fraud,which came into effect on December 1,2022,provides a comprehensive and powerful legal guarantee for the regular anti-fraud work,and has solved some long-standing pain points and difficulties in the governance of the telecom industry.However,we should also be aware that anti-telecom network fraud has entered the "deep-water area".In the face of the fraud gangs characterized by "industrialized distribution,group operation,refined work division,and cross-border layout",some deep-seated industry governance problems are being gradually exposed,and it is urgent for the telecom industry to introduce more accurate,efficient,and thorough governance measures.In this research,the author took the collaborative governance theory and the holistic governance theory as the main theoretical basis,and the telecom industry in Shanxi Province as the specific research object.This article first analyzes the current situation of the governance of the telecom industry combat telecom and online fraud in Shanxi Province,briefly explains the legal system for the governance of the telecom industry combat telecom and online fraud,the establishment of the governance system for the telecom industry combat telecom and online fraud in Shanxi Province,and the new trends in current telecom and online fraud activities.Then,based on real cases,this article points out that there are prominent problems in the current governance of the telecom industry in Shanxi Province combat telecom and online fraud,such as failure to achieve real name registration of SIM card,prominent fraud related to Io T cards,damage to the rights and interests of normal users,and multiple supervision facing telecom enterprises.The problem causes are further studied in a deep-going way and four problems in the current telecom industry of Shanxi Province are pointed out,namely,the lack of "integrity" in the governance policy,the weakness in the coordinated governance of the industry,the loopholes in the internal management of the enterprises,and the imperfect technical countermeasures.On the basis of the above study,combined with the author’s work experience in Shanxi Provincial Communications Administration Bureau,the author puts forward the following suggestions on the measures for enhancing the governance capacity of Shangxi telecom industry: we should improve the overall governance effectiveness of the government,perfect the supporting policies for telecom supervision,strengthen the coordination among the market players in governance,and build a precise system of technical defense and countermeasures.Finally,the author summarizes and reviews the study to form conclusions,and points out the limitations and shortcomings of the present study.
