Archival information is an information resource collected or solicited by archives from various units,social organizations,and individuals of the country."Serving society" is not only an obligation stipulated in the Archives Law of the People’s Republic of China(hereinafter referred to as the "Archives Law")and related laws,but also an important way for archives,as national public institutions,to realize their own value.The balance of interests is the legislative basis and basic element of intellectual property law.In the modern sense,intellectual property is a policy requirement that transforms the intellectual labor achievements of creators into their economic interests through law,in order to promote technological development and social progress,while protecting certain specific interests.Essentially,archival information is primarily a knowledge product.Archive information service is a public information service provided by archives in accordance with the Constitution of the People’s Republic of China(hereinafter referred to as the "Constitution"),the Archives Law,and intellectual property related laws.With the advent of the digital age,the development of digital and network technologies has changed the ways,conditions,and methods of copying,disseminating,and utilizing archival information in traditional society,breaking the balance between public and private interests in archival information services.The issue of intellectual property rights in archival information services has become one of the current thorny issues.Secondly,the article provides an in-depth analysis of the intellectual property protection issues in archival information services,pointing out the inevitability of the problems.It is believed that in the digital era dominated by "online services",the development of science and technology has a significant impact on archival information services,especially the intellectual property risks involved in digital information services.The article also discusses the issues of archival information replication,information database construction,information retrieval,network dissemination,international services A detailed analysis was conducted on several aspects of daily management and other work processes,including the potential risks involved due to technological influence.Factors affecting intellectual property protection in the digital era archive information service were explained.Secondly,the article provides an in-depth analysis of the issue of intellectual property protection in archival information services,pointing out the inevitability of the problem.Firstly,there is a contradiction between the public nature of archives and the private nature of intellectual property in archival information.Secondly,there is a contradiction between the mandatory responsibilities of archives and the exclusive nature of intellectual property.Thirdly,there are many contradictions in the complex interests of the three parties in archival information services.It is believed that in the digital era dominated by "online services",the development of science and technology has a significant impact on archival information services,especially the intellectual property risks involved in digital information services.A detailed analysis was conducted on the possible risk points that may be involved due to technological impact from several aspects of work,such as archival information replication,information database construction,information retrieval,network dissemination,international services,and daily management,Explained the factors that affect intellectual property protection in archive information services in the digital era.Finally,based on the current situation of intellectual property protection in archive information services in the digital era,the article proposes four dimensions of thinking on intellectual property protection strategies in archive information services.One is to improve laws and regulations and build a rule of law society.Optimization measures have been proposed from the perspectives of social awareness of archive protection and the construction of a rule of law society.The second is to build safety barriers and strengthen technical and management guarantees.Strengthen the security of archival information services in the network environment from the perspectives of software technology support,hardware technology enhancement,and data management technology control.The third is to enhance social protection awareness and strengthen the professional ethics standards of archival practitioners.Not only should personnel training be strengthened,but also attention should be paid to summarizing and exchanging experiences between libraries.Fourthly,establish other coordination mechanisms to achieve multiple channels for protecting interests.Establish a coordination mechanism from three aspects: economic interests,ethical order,and rapid mediation,to achieve a win-win situation between information services and intellectual property protection.At present,the trend of global economic globalization is becoming increasingly evident,and the development and iteration of science and technology are becoming faster and faster.In this context,the information services of archives will also undergo tremendous changes.Therefore,in order to achieve the ultimate goal of "serving society",archives must comply with the trend of scientific and technological development,enhance legal protection awareness in the daily management and service of archival information,further clarify their responsibilities and obligations,and standardize daily management;At the same time,actively studying the needs of the public,exploring the laws,characteristics,and methods of archival information services from the perspective of interdisciplinary theories such as law,computer science,and ethics,and ultimately achieving legal governance of archives.
