Research On Intellectual Property Protection Of Digital Electronic Technology In China

After the third plenary session, a deep reform had been done in our country, economic、 political which contains legal system reform and cultural all have been involved. As the international competition is fierce increasingly,the weapons-war which is the most extreme way has gradually disappeared in peacetime.According to’law of conservation of energy’, A form of material will not disappear suddenly, but shows in a different form, competition works in the same way. The end of war tell us the competition of technology has already arrived. The competition of technology include the competition of digital electronic technique.Digital electronic technique can divided into three categories:hardware components of digital electronic technique, integrated circuits and computer software section.In the second chapter,we discuss the protection of intellectual property in hardware,compare the world’s intellectual property protection with domestic’s,they are nearly the same but the execution of infringement is not well-executed.The third chapter describes digital electronic technology have circuit integrated,discuss the pattern of intellectual property protection which is mainly the legislation protection pattern from the characteristic of integrated circuit.We also use it in our country,but there will be a disadvantage of low rank of specific legislation. The forth chapter talk about the intellectual property protection in computer software section in digital electronic technique.Use the case of judicial decision of computer software in United States to carry out the intellectual property protection in computer software section in China.In the fifth chapter and conclusion,mainly talk about the solutions of intellectual property protection in digital electronic technology in China,to figure out how to solve the disadvantages in the first three chapters,and give own opinions.
