| In recent years,with the rapid development of global digital technology,traditional trade in services has been transformed to digital trade in services.Digital trade in services has shown strong resilience and great potential for development,and gradually become an important engine for global trade growth.In order to promote the development of digital service trade,countries have signed trade agreements covering digital intellectual property rules in line with their own interests,so as to provide a good international trade environment for their digital service trade export.Developed countries started earlier in the field of digital service trade,formed the "American template" and "European template" covering digital intellectual property rules,occupied the leading position in global digital trade,and introduced a number of policies,laws and regulations related to digital intellectual property rules.At present,China has also begun to actively respond to this new round of global digital trade competition,and made it clear that China should accelerate the digital development,further promote the digital transformation of the service industry,and build a digital China.This thesis first defines the concept of digital service trade,and makes it clear that the digital service trade studied in this thesis includes six categories: insurance and pension service,ICT service,personal entertainment service,financial service,other business service and intellectual property royalty service.Then,the deep scoring method of digital intellectual property rules in this thesis is explained to clarify the measurement of digital intellectual property rules in trade agreements in this thesis.Then,the development status of digital service trade export and digital intellectual property rules is analyzed.Based on the TAPED database,the six types of digital delivery services are classified and summarized,and the export pattern of global digital service trade is further analyzed from four dimensions: global,continent,different economy and China.It is found that the European Union and the United States account for a large proportion of the global digital service trade export,but the growth rate of China’s digital service trade export is much higher than that of developed countries such as the United States and Europe,which indicates that China’s digital service trade export development potential is huge.The scores of digital intellectual property rules signed by representative economies are added up,the development pattern of global digital intellectual property rules is analyzed,and the proportion of various digital intellectual property rules in the RTAs signed by the United States,the European Union and China is highlighted,and the emphasis on the development of digital intellectual property rules is analyzed.Digital intellectual property rules can affect the export of digital service trade through direct effects such as market expansion and market domination,as well as indirect effects such as FDI,independent innovation,industrial structure upgrading and human capital.In the empirical study,based on the TAPED database and text quantification method,this thesis analyzes the relevant regional trade agreements signed by 69 major economies in the world after 2000 and continuously in force from 2012 to 2019,selects the provisions related to digital intellectual property rules,and collects and analyzes the scores of text provisions of trade agreements.The depth index of digital intellectual property rules is constructed,and its influence on the export of digital service trade is analyzed empirically based on the extended trade gravity model.The baseline regression results show that the depth of digital intellectual property rules can significantly promote the export of digital service trade.Heterogeneity analysis shows that when the exporting country is a developed country and the importing country is also a developed country,the enhancement of the depth of digital intellectual property rules between the two countries has a greater promoting effect on the export of digital services of the exporting country.The results of the mediation effect test show that the enhancement of the depth of digital intellectual property rules can promote the export of digital services trade by reducing the difference in the level of infrastructure between the two countries,and can promote the export of digital services trade by increasing the respective FDI of the two countries.Based on the empirical results and analysis,this thesis puts forward relevant suggestions.First of all,the world should strengthen the uniformity of digital intellectual property rules,sign more digital intellectual property rules closely related to the Internet,and improve the construction of relevant laws and regulations around the world.When developing digital intellectual property rules,developed countries should also vigorously help developing countries in the construction of digital intellectual property rules.Secondly,developing countries should actively participate in the negotiations on digital intellectual property rules,strive for the right of international discourse,and actively put forward the issues conducive to the development of digital service trade of developing countries.Finally,China should selectively align international digital intellectual property rules,not blindly follow the trend,learn from the European and American digital intellectual property protection rules suitable for China’s relevant provisions,vigorously develop the domestic digital service trade industry,enhance international competitiveness,actively establish and improve relevant laws and regulations,and safeguard national digital network security. |
