In the 1970s,Tibet followed the national pace of people’s mediation work and kicked off the prelude of people’s mediation in Tibet.To date,more than forty years have passed.During these forty years,the development of people’s mediation in Tibet has gone through four stages:the period of recovery,the period of stable development,the period of slow development,and the period of rapid development.Nowadays,people’s mediation plays an important role in social governance at the grassroots level in Tibet with the advantages that other dispute resolution methods do not have.In spite of this,there are still shortcomings in practice.The application of people’s mediation in grassroots social governance in Tibet is studied to provide possible improvement measures to promote the development of people’s mediation in Tibet and enhance the role of people’s mediation in grassroots social governance in Tibet.Obtaining the required research information through observation method,interview method,etc.The study of the application of people’s mediation in Tibetan grassroots social governance is then conducted by the literature analysis method,case study method,and inductive analysis method.To summarize the practice pattern and operation status of people’s mediation in Tibetan grassroots social governance,analyze the effectiveness of people’s mediation in Tibetan grassroots social governance,and clarify the role of people’s mediation for Tibetan grassroots social governance.People’s mediation makes up for the adversarial nature of justice,responds to the emotional needs of the parties,resolves the antagonism between them,and satisfies the core of grassroots social governance-the maintenance of harmony between people.And with its inclusiveness,it resolves new types of disputes that cannot be included in the judicial settlement,and achieves the purpose of "settling the case and reconciling the people".This is to maintain social stability and the unity of the various ethnic groups living in Tibet,and to promote the formation of a governance system that integrates the rule of law,moral governance and autonomy in Tibetan grassroots social governance.In Tibetan grassroots social governance,although people’s mediation plays an important role,there are still deficiencies in both mediation team construction and mediation service capacity in practice.The lack of mediation team building is mainly reflected in the lack of full-time mediators,weak professional skills of mediators and insufficient motivation of mediators.The lack of mediation services is mainly reflected in the fact that "similar cases have different outcomes" and their role in dispute resolution has not achieved the expected results.For people’s mediation to play a greater role in grassroots social governance in Tibet,it needs to improve the shortcomings that currently exist.Strengthen the construction of the people’s mediator team by optimizing the staffing of the mediation team,enhancing the professional skills of mediators,and improving the incentive mechanism for mediators.To promote the systematization and standardization of people’s mediation and improve the rule of law guarantee of people’s mediation to enhance the capacity of people’s mediation services.Through the study of the application of people’s mediation in Tibetan grassroots social governance,it is found that people’s mediation plays a role in Tibetan grassroots social governance through its unique operation and advantages in the face of the uniqueness and complexity of conflicts and disputes in Tibetan grassroots society.The shortcomings of people’s mediation in practice are identified,and corresponding improvement measures are provided for its shortcomings. |
