Research On The Legal Regulation Of Cyber Violence

The development of the Internet has created conditions for the widespread dissemination and access to information,but it has also bred cyber violence.Cyber violence is network users use online platforms as a medium to slander,insult,and human flesh search others,which not only infringes on the legitimate rights and interests of citizens,but also causes great damage to public order.Nowadays,the development of cyber violence in China has a tendency to intensify,and the target of cyber violence has changed from public figures in the early days to ordinary citizens now.The blackmail trend of cyber violence has also become a potential destabilizing factor threatening the network order.In view of this,it is urgent to improve the legal regulation system of cyber violence in China.Based on the existing research results,this paper compares the causes of cyber violence and,on this premise,compares the similarities and differences between the legal regulation of cyber violence in overseas countries on a macro level and summarizes the experience applicable to China;on a micro level,it focuses on the typical cases of cyber violence in the new media era and compares the definition and manifestations of cyber violence.The final conclusion is that in order to improve the legal regulation system of cyber violence,the legislation on cyber violence should first be improved from the perspective of the legal liability system and electronic evidence.At the same time,the legislation on cyber violence should be echoed and supported from the law enforcement and judicial levels.Specifically,at the law enforcement level,a multifaceted regulatory mechanism should be formed to improve China’s online real-name system.At the judicial level,it is necessary to open up the relief channels for the rights holders and make provisions for the territorial jurisdiction of cyber violence.From the above three dimensions,a framework for regulating cyber violence should be constructed,with a view to curbing the trend of cyber violence,maintaining the stable operation of the cyber order,and making "clarity" the new standard of cyberspace.
