With the rapid development of digital economy,telecommuting has gradually become a normal office mode.The normalization of telecommuting has both positive and negative effects.To protect the rights and interests of telecommuting workers is the key to play the positive role of telecommuting mode.Especially in the current environment of economic downturn,the protection of the rights and interests of telecommuting workers is not only conducive to the protection of the rights and interests of new business types of workers,but also can provide a guarantee for the sound operation of the new model of digital economy.But as the new labor mode,the particularity of the remote office has decided that the adaptability of Chinese labor law and other relevant regulations is not enough,especially the good protection of laborer’s rights,so the study on the remote office worker’s rights protection is very necessary.This paper takes the new employment form as the background to study the protection of workers’ rights and interests under the telecommuting mode,and mainly uses literature analysis,case analysis and summary method to analyze and demonstrate.The paper is divided into four parts.The first part defines the connotation and characteristics of telecommuting,indicating the positive role of telecommuting employment mode under the background of new employment and the particularity of telecommuting workers’ rights and interests protection.The second part,through the analysis of the specific situation,summarizes the current situation of the rights and interests of telecommuting workers,the analysis of difficulties including labor relations identification difficulties,occupational injury identification difficulties,difficult to define the right to rest.The third part summarizes the experience of telecommuting workers’ rights and interests protection in the United States,the European Union,Japan and other countries and regions,and draws enlightenment.The fourth part,combined with our laborer rights and interests protection system and reasonable reference to foreign practices,put forward some suggestions for system improvement in light of specific difficulties,including the definition of labor relations should be based on the construction of labor relations judgment standard,suggesting the establishment of a category of "employee-like";In terms of the protection of the right to rest,the measures to protect the right to rest of telecommuting workers should be clearly defined.In terms of occupational injury protection,it is necessary to refine the measures for remote workers to protect occupational injuries and improve the identification standards for occupational diseases.At the same time,it gives some suggestions to perfect the way of protecting the rights of telecommuting workers.The research can further enrich the theory of protection of workers’ rights and interests,and provide solutions to practical problems.
