After twenty-first Century,with the rapid economic development,China entered the aging society.With the advent of the aging society and the fact that it is not rich,the aging has become an important factor affecting the economic and social development of our country.Among the many micro problems,the topic of the re employment of the elderly deserves our attention.So a new type of labor relations in our perspective of retirement.With the increase in the number of elderly re employment,retirement is also growing.Because of their own characteristics,the employment of the elderly has positive significance both for the individual and the society,and they have been widely favored by the society for its unique advantages.However,our law does not regulate good retirement of this behavior,the absence of legislation,the retirement personnel identity cannot be clearly identified,industrial disputes cannot be solved properly,labor remuneration right not many controversial issues fully protection,pension insurance.Such aspects are hindering the retirement personnel to realize their own rights.In order to clearly understand the retirement,this paper first analyzes the concept of "source of retirement" and "retirement" from theory,further analyzes the causes of the phenomenon of retirement,then according to their own ideas set out the necessity of protecting the rights of the retirement personnel;secondly from the legislative aspects of status for the retirement community the legal protection of the country,and then analyzes the deficiency of national retirement personnel for the protection of the rights of existence.Through the observation of the central and local legislation,we can see that the overhead of legislation,leading to retirement staff identity identification,work-related injury,wages,insurance and school-age workers compared to the degree of protection is insufficient;then this paper uses the research method of comparative analysis,study the legislative experiences of the developed countries the United States,Britain and Japan.To draw on their retirement personnel rights protection legislation,the attitude of tolerance,strike discrimination,information accessibility makes their national retirement more personnel with professional and happiness.Finally,in the understanding of foreign basic theory for the research and Practice on the retirement,summed up the experience,enabling China to put forward some suggestions about improving the protection of the rights ofthe staff retirement.One of the most important is the determination of working status,to improve gradually promoted inductrial injury,wages,pension insurance.Only identified the retirement personnel identity of laborer,to expand the scope of work injury insurance,and ultimately better achieve equal pay.At the end of the article,it is pointed out that in order to further improve the retirement system,it is necessary to postpone the retirement age to realize flexible retirement.Here shows the advantages of flexible working time and the nature of the work in the retirement age,retirement and strength of free choice flexibility,to gradually improve the retirement system so as to better protect the rights of the staff retirement.
