| While the phenomenon of population aging in our country is increasing,the labor force is in short supply,and the social pension pressure is increasing.A large number of overage workers enter the labor market,not only satisfying their own life needs,but also contributing to employers and society.However,our country does not provide adequate protection of the rights and interests of overage workers in industrial injury insurance.The imperfect legislation leads to the disunity of judicial results.This makes it difficult for overage workers to seek industrial injury insurance relief after being injured at work,and it is difficult for their rights and interests to be effectively protected.This article is based on the judicial and legislative status of protecting the rights and interests of overage workers’ industrial injury insurance.In view of the problems in the protection of the rights and interests of overage workers in industrial injury insurance,such as the unclear nature of the legal relationship,the unclear whether overage workers can enjoy industrial injury insurance benefits,and the limitations of existing legislation.Reasonable suggestions were put forward in order to explore ideas that are conducive to protecting the rights and interests of overage workers in industrial injury insurance. |
