Research On IPR Enforcement In Laos Under RCEP Agreement

The RCEP agreement contains a large number of intellectual property enforcement systems,covering general obligations of intellectual property enforcement,civil and administrative procedures,interim remedies,criminal procedures and border measures,etc.,providing guidance for the construction of intellectual property enforcement systems in the contracting states.The signing of RCEP is an important opportunity for Laos.However,considering the current situation of intellectual property enforcement,judicial enforcement and intellectual property dispute resolution procedures in Laos,under the intellectual property enforcement rules of the RCEP agreement,the construction of intellectual property enforcement rules in Laos faces two challenges.serious problem.On the one hand,there is an imbalance of interests in the face of excessive protection of intellectual property rights,including the imbalance between individual interests and public interests in intellectual property enforcement rules,and the imbalance in enforcement between intellectual property rights in developed countries and intellectual property rights in Laos.On the other hand,Laos faces the problem of difficulty in adapting to high-standard intellectual property enforcement rules.Faced with these problems,it is necessary for Laos to improve its national intellectual property system,including improving civil judicial procedures,interim remedies,administrative procedures and remedies,criminal procedures and special border measures.By studying the issues of intellectual property enforcement in Laos under the RCEP agreement,it is possible to further enrich the improvement of the Laotian intellectual property enforcement rules under the RCEP agreement system.
