Research On RCEP Intellectual Property Trade Rule

RCEP is currently the most populous,largest and most promising free trade agre ement in the world.Its Chapter 11,Intellectual Property,constitutes the most importan t chapter of the entire agreement with the most articles and length.The formulation of international intellectual property rules is conducive to protecting the rights of intellec tual property rights holders in international trade,and trade promotes technological pr ogress in regions or countries.Studying the intellectual property rules of RCEP is of great significance to the development of intellectual property rights in my country.The article first expounds the basic issues of the RCEP intellectual property trade rules,introduces the relationship between the RCEP intellectual property trade rules and the TRIPS agreement,and points out that the RCEP intellectual property trade rules not only use the TRIPS agreement as a template,but also reiterate the important provisions of the TRIPS agreement,and many new TRIPS-Plus rules with high protection standards have been added.Secondly,by listing the special provisions of RCEP intellectual property trade rules to illustrate its forward-looking,flexible and inclusive characteristics,and then comparing RCEP with CPTPP and USMCA,two regional trade agreements with the same high protection standards,and analyzing the three The main differences between copyrights,patents and trademarks and find out the advantages of RCEP intellectual property trade rules,indicating that RCEP intellectual property trade rules are more exemplary and can bring higher innovation effects.Finally,it points out the lack of rules in the RCEP intellectual property trade rules and the difficulties faced by China in implementing the RCEP rules,and proposes solutions from two perspectives.From the perspective of improving the RCEP intellectual property trade rules themselves,on the one hand,we can establish the RCEP intellectual property dispute settlement rules by referring to the WIPO dispute settlement mechanism,and on the other hand,we can refer to the China-US Economic and Trade Agreement to formulate technology transfer rules and improve the coordination mechanism for intellectual property cooperation;In other words,we can learn from the intellectual property systems of other RCEP member states to revise domestic legislation and coordinate and improve my country’s intellectual property legal system.
