| Under the background of deepening economic and trade globalization,intellectual property,as an important strategic resource,has been paid more and more attention by countries all over the world.However,with the progress and development of the times,the TRIPs agreement is difficult to meet the needs of some intellectual property powers,believing that the agreement has harmed their national interests,and has continuously improved the level of intellectual property protection through bilateral or multilateral agreements.Intellectual property clauses are also born out of this trend.The RCEP agreement is the largest free trade agreement in the world in history,and it is a comprehensive,high-level and win-win free trade agreement.The intellectual property chapter,which consists of 83 articles on genetic resources,anti-unfair competition,and intellectual property civil remedies,and two extremely important annexes,is undoubtedly the most abundant chapter in the RCEP agreement.The RCEP agreement is the latest giant free trade agreement in the world.By studying the civil remedies rules in the RCEP agreement and comparing it with the intellectual property civil remedies rules in international agreements such as CPTPP and USMCA.On the one hand,it can accurately grasp the development trends and trends of international intellectual property protection,and provide a reference for the future innovation and revision of the TRIPs agreement;The civil remedy rules in the articles,and through the reference and reference of the relevant provisions in the RCEP agreement,can summarize the specific problems existing in the development of my country’s intellectual property system,thereby improving the quality of my country’s intellectual property legislation and improving my country’s intellectual property rights Legal System.In addition,most of the current member states of the RCEP agreement are both my country’s neighbors and countries along the "Belt and Road" initiative,and they have close trade relations with each other.In the future,in the process of trade between my country and these member states,the research results of the RCEP agreement on intellectual property civil remedy rules can be used to adapt to the high-standard intellectual property protection systems of other countries more quickly;and to solve the "Belt and Road" initiative in practice The intellectual property frictions generated in China provide experience to promote the continued development of the "Belt and Road",while insisting on safeguarding national interests.Therefore,in the first part of this article,the author briefly analyzes the main provisions of the RCEP agreement on intellectual property rights,and summarizes the characteristics of the RCEP agreement’s intellectual property civil remedy rules.The content of the second part to the fifth part is the core content of this thesis,and this part mainly analyzes the specific rules of the RCEP agreement on intellectual property civil remedies.Starting from the four aspects of civil remedy procedure rules,related civil liability,protection of confidential information and provisional measures rules,it compares with international agreements such as TRIRs agreement,CPTPP agreement,USMCA agreement,ACTA agreement and relevant rules of my country’s domestic law.Analyze and explain in detail the main content and characteristics of the civil relief rules of the RCEP Agreement.The sixth part is about the impact of the RCEP agreement on my country and the corresponding countermeasures.Briefly describe the impact of the RCEP agreement on my country’s intellectual property protection mechanism,and based on my country’s national conditions,put forward strategies to adjust my country’s intellectual property civil remedies rules in a timely manner,focus on international intellectual property enforcement and business cooperation,and promote the benign interaction between the RCEP agreement and other international mechanisms.,in order to promote the effective implementation of the RCEP agreement and improve my country’s intellectual property legal system. |
