Study On Legal Issues Of River Chief Systems In Liaoning Province

River chief system is a river management system explored in our country.By making clear the responsibilities of all parties,implementing the supervision and assessment mechanism,we strengthen the protection and management of the water resources.The Opinions on Comprehensively Implementing the River Chief System,jointly issued by the Central Government Office and the State Government Office in2016,is the starting point for comprehensively implementing the river chief system in China.In the same year,Liaoning Province began to implement the river chief system,and has formulated a series of policies and regulations.At present,a five-level river chief system has been fully established at the provincial,city,county,township and village levels.Liaoning Province has numerous river basins and densely covered rivers,which is not easy to control.The implementation of the river chief system is an important measure to solve the severe water ecological environment problems in Liaoning Province.Although Liaoning Province has achieved some actual results in the comprehensive implementation of the river chief system in recent years,it still faces some legal problems in the implementation process.Taking the river chief system of Liaoning province as the research object,this paper studies the legal issues of the river chief system of Liaoning province from four parts,and puts forward suggestions to improve the system in view of the deficiencies existing in the implementation process of the river chief system of Liaoning Province,drawing on the experience of watershed governance at home and abroad.The first chapter is the related overview of the river chief system.This paper mainly introduces the concept of river chief system.The theory of environmental rights,environmental public trust theory and cooperative governance theory are the theoretical basis of river chief system.The legal basis related to the river chief system and the emergence and development of the river chief system in Liaoning Province.The second chapter combs the implementation status and existing legal problems of the river chief system in Liaoning Province.The present situation of river chief system in Liaoning Province is introduced from two aspects: organization system and implementation mechanism.It is found that the river chief system in Liaoning province mainly has some problems,such as the absence of relevant legal basis,the unclear allocation of powers and powers of the responsible subjects,the imperfect examination and accountability mechanism and the absence of public participation and supervision.The third chapter is the practical experience and enlightenment of watershed governance at home and abroad.Among the foreign river basin governance,the Thames Basin integrated governance model is implemented in Britain.The United States through uniform legislation and broad public participation in the governance of the Tennessee River basin;France set up river basin administration and river basin commission.In the construction of river chief system in China,Pujiang County and Hangzhou City of Zhejiang Province have better practices in terms of operation mechanism and public participation for reference of Liaoning Province.Through sorting out the above governance experience,it sums up the enlightenment of establishing a perfect legal system,establishing an overall governance mechanism and improving the social public participation.The fourth chapter puts forward the legal countermeasures to improve the river chief system in Liaoning province,including: establishing and perfecting the laws and regulations system of river chief system;Refining the relevant provisions of the river chief System of Liaoning Province on the division of responsibilities between river chiefs and other water-related functional departments at the same level;In this paper,we improve the examination and accountability mechanism of river chief system in Liaoning province from three aspects: the subject,content and way of accountability.The public participation and supervision mechanism of the river chief system in Liaoning Province should be perfected by improving the information disclosure system of the river chief system,formulating relevant regulations of social supervision and guaranteeing the full participation of the public.
