Research On The Legislative Issues Of River Chief System

In order to ensure the sustainable development of the water environment of rivers and lakes.In 2018,China realized the full coverage of the ‘River Chief System’ system nationwide.Based on the investigation of the implementation of the ‘River Chief System’ in25 villages in D City,Jiangsu Province,the article analyzes the implementation of the ‘River Chief System’ in China.Combined with the cases reported by the Central Environmental Protection Inspectorate and the field investigation in D City,it is concluded.Common problems in the local implementation of the ‘River Chief System’.Although the newly promulgated ‘Yangtze River Protection Law’ provides supplement and support to the legal basis of the river chief system,but the actual implementation of the river chief system in various places still reveals some problems,how to develop the river chief system into Chinese water environment.There are still many areas worthy of research and discussion on the longterm governance mechanism of management and protection.With the full implementation of the river chief system in all parts of the country,and the official incorporation of the river chief system into the ‘Water Pollution Prevention and Control Law’,and the promulgation of the ‘Yangtze River Protection Law’,it all shows that the river chief system plays an important role in the management and protection of the water environment.The strategic position in which it is located all indicates the inevitability of the legalization of the river chief system.The study of the river chief system from a legal perspective has its legal basis.The river chief system is a strengthening of the local government’s responsibility for environmental protection supervision in the region,a natural extension of the party and government’s shared responsibility for environmental protection,and an institutional embodiment of citizens’ environmental rights.Legislation should be close to reality,respond to reality,and give full play to the function of effectively solving emerging social problems.The article selects D city for research,and studies its achievements and remaining deficiencies in the process of its implementation.In addition,through the comparative analysis with the typical cases reported by the central inspection team,it is found that there are common problems in the current situation of the implementation of the river chief system in my country.There are three legal issues: lack of scientific assessment and accountability mechanism,and lack of public participation and supervision.Aiming at the legal problems existing in the water environment management and protection of the river chief system,after analyzing the reasons for its formation,it tries to find a line of action from the experience of three typical river basin water environment governance that has similarities with Chinese governance status.This paper analyzes the system design adopted in the basin governance of the Tennessee River Basin,Thames River Basin and Murray-Darling River,and draws enlightenment for our country to learn from.Finally,it puts forward four suggestions on improving legal regulations,building legal and reasonable powers and responsibilities,strengthening the accountability mechanism of the river chief system,and ensuring public participation and supervision,in order to complete the improvement of the legal mechanism of the river chief system.
