On The Practice Of Xi Jinping Thought On The Rule Of Law In Ethnic Areas

The Central Work Conference on Comprehensively Governing the Country by Law for the first time clarifies Xi Jinping Thought on the Rule of Law as the guiding ideology for comprehensively governing the country by law.Xi Jinping thought on the rule of law embodies the innovative achievements of our party in the field of the rule of law and is a necessary condition for promoting the modernization of the national governance system and governance capacity.It is also the general outline and basic guiding ideology for the construction of the rule of law in ethnic regions,and it is of great significance to practice Xi Jinping thought on the rule of law in the development of the rule of law in ethnic regions.This paper first clarifies the great significance of Xi Jinping thought on the rule of law in guiding the construction of the rule of law in ethnic regions in China.As the guiding ideology for the comprehensive advancement of the rule of law in China,Xi Jinping thought on the rule of law occupies a core guiding position in the construction of the rule of law in China.The construction of the rule of law in ethnic regions,as an inevitable requirement for comprehensive rule of law,must follow Xi Jinping thought on the rule of law as a fundamental guideline.As the scientific guidance and powerful magic weapon for the construction of the rule of law in ethnic regions in China,Xi Jinping thought on the rule of law fully applies systematic and dialectical thinking methods to point out the direction of the construction of the rule of law in ethnic regions.To explore the practice of Xi Jinping thought on the rule of law in the construction of the rule of law in ethnic regions in China,it is necessary to clarify the uniqueness of the construction of the rule of law in ethnic regions.Starting from the experience of the rule of law of ethnic minorities,this paper summarizes the problems existing in the construction of the rule of law in ethnic regions in China,and analyzes the background factors that have led to these problems.At present,the current legal and normative system of the rule of law in ethnic regions is still insufficient,and some policy documents issued in ethnic regions are weak in legitimacy.Some ethnic regions are infiltrated by Western anti-China ideology and extremist religious thoughts,which affects the security of the rule of law construction.The scientific nature of government construction of the rule of law in ethnic regions is insufficient.The impartial judicial process encounters certain obstacles due to ethnic factors,with insufficient judicial authority and judicial conflicts between customary law and written law.The legal awareness of the people in ethnic regions urgently needs to be improved,and the construction of local legal teams is relatively weak,making it difficult to exert efforts in the construction of the rule of law in ethnic regions.Fundamentally,the construction of the rule of law in China’s ethnic regions has been adversely affected by factors such as geographical conditions,lagging economic development,a rural-dominated social population distribution structure,and extreme cultures.Xi Jinping thought on the rule of law points out the correct direction for the construction of the rule of law in ethnic regions.First and foremost,the construction of the rule of law in ethnic regions must adhere to uphold fundamental principles and break new ground,and simultaneously establish a rule of law path that is in line with the characteristics of ethnic regions while adhering to the party’s leadership and the people-centered stance.Second,the fundamental position of the constitution in the construction of the rule of law should be clarified.Third,the basic goal of the rule of law construction should be to foster a sense of community for the Chinese nation and promote the common prosperity and progress of all ethnic groups.Fourth,problems should be viewed with a dialectical perspective,correctly handling the relationship between reform and the rule of law,development and security and stability.Fifth,it is necessary to promote the modernization of the governance system and governance capacity in ethnic regions on the track of the rule of law,and implement it concretely to adhere to the "three-in-one" joint advancement of ruling the country by law,governing by law,and administrating by law.Sixth,it is necessary to adhere to the joint construction of scientific legislation,strict law enforcement,fair justice,and law-abiding by the whole people in ethnic regions.On this basis,aiming at the special problems existing in the construction of the rule of law in ethnic regions in China,this paper further implements Xi Jinping thought on the rule of lawt in the rule of law practice in ethnic regions,and puts forward the practice path of Xi Jinping thought on the rule of lawt in the construction of the rule of law in ethnic regions,as follows: It is necessary to improve the legislation in ethnic regions;to combat and prevent separatism and terrorism;to further promote the reform of government functions,improve the administrative system according to law and comprehensively promote the construction of supervision mechanisms of government work;to properly handle the relationship between national laws and ethnic customary laws at the judicial level;to optimize the construction of the rule of law in the social of ethnic regions,especially the construction of the rule of law in rural regions,and make use of local resources in accordance with local conditions in the rule of law construction;while strengthening the rule of law publicity and education in ethnic regions,improve the shortage of legal talents by strengthening the construction of rule of law teams in ethnic regions.Under the guidance of Xi Jinping thought on the rule of law,the above measures must be taken simultaneously to make full use of local resources in ethnic minority regions and promote the construction of the rule of law in ethnic regions on the premise of satisfying local characteristics.
