Research On The Application Of Platform Economy To Pre-monopoly Supervision

Platform enterprises are a key core part of the rapid development of the platform economy,and platform enterprise competition is a double-edged sword,on the one hand,it promotes the development of social and living order in a new direction,but at the same time it also generates new uncertainties,resulting in frequent illegal monopoly phenomena that harm competition,innovation and consumer interests,so the anti-monopoly call for platforms is also increasing globally.Compared with traditional enterprises,the monopolistic behavior carried out by platform enterprises has completely different monopoly characteristics.As a product of the industrial economic era,it is difficult to stop its "natural" monopoly tendency through passive regulatory means.Because of this,anti-monopoly law enforcement authorities need to adopt front-end anti-monopoly supervision as the main means to regulate the activities of platform enterprises when their monopolistic behavior is implemented.The existing regulatory methods of post-event passive law enforcement cannot meet the regulatory needs of the platform economy field,and there are problems such as difficulties in applying anti-monopoly analysis tools,timely and effective passive supervision,and incomplete laws,and it is necessary to change the supervision methods.Extraterritorial countries face the same situation,the European Union,the United States,Germany and other countries have made measures to shift the focus of supervision forward,the application of pre-regulatory methods has become a global consensus,on the basis of sufficient extraterritorial experience for reference,China should also transform the existing regulatory methods,apply pre-monopoly supervision,from the theoretical basis and implementation methods to supplement the post-event anti-monopoly law enforcement,in order to make up for the shortcomings of post-event passive law enforcement.In order to enable the platform economy to apply the pre-monopoly supervision method to operate smoothly on the track of the rule of law and better apply it in China,it is necessary to build the top-level design and underlying foundation of the platform economy pre-monopoly supervision.The top-level design is to follow certain principles for pre-imposed supervision,and to reflect and innovate on the application of the principle of inclusiveness and prudence in the field of anti-monopoly supervision,so as to demonstrate that the core criterion of pre-monopoly supervision is to promote the advancement and innovation of enterprises while conforming to development norms,building an effective market while ensuring that the government has a difference,being careful and prudent,and strengthening the scientific nature of pre-monopoly supervision.The underlying foundation is that pre-monopoly supervision requires supporting systems to lay a solid foundation for pre-monopoly supervision to play a full role.In applying standards,attention should be paid to markets with high barriers to entry,poor competition,lagging remedies and regulatory practices that allow the benefits to outweigh the costs;In terms of detailed measures,attention should be paid to strengthening the anti-monopoly compliance supervision of platform enterprises and strengthening front-end intervention in the monopolistic behavior of platform enterprises;In terms of ensuring implementation,an evaluation system for supervision should be introduced,coordination with other systems should be handled,and anti-monopoly supervision capabilities should be strengthened.
