Research On Antitrust Regulation Of “One Out Of Two” Behavior In The Field Of Platform Economy

With the rapid development of platform economy,the phenomenon that platform subjects adopt the strategy of "Choose One out of Two" is increasing day by day.How to regulate it by anti-monopoly law,so as to achieve the dual purpose of protecting consumers’ legitimate rights and interests and ensuring the market economic order,has become one of the focuses of legislation and research.Based on the particularity of the platform economy,this paper aims to explore the anti-monopoly theory and legal regulation path for this behavior.First of all,this paper accurately grasps the theoretical definition of "Choose One out of Two " behavior in the field of platform economy.In terms of the definition of the scope of the platform,this paper creatively puts forward the view that the platform market is not limited to the commodity trading market.Secondly,since most platform economies are bilateral markets,accompanied by network externalities,consumer lock-in effects and other characteristics,it is difficult to continue to apply the regulation path of traditional monopoly behavior in the era of big data.More importantly,the "Choose One out of Two" behavior has strong positive benefits.It is extremely important to explore the anti-monopoly legal system under the principle of rationality.Therefore,this paper clarifies the important theoretical basis for the anti-monopoly regulation of the "Choose One out of Two" behavior,and gradually analyzes the practical dilemma that the various identification links of the "Choose One out of Two" behavior are different from the traditional industry market.In addition,through comparative analysis and other methods,this paper combs the regulation and deficiencies of China’s current legal system on the "Choose One out of Two" behavior,and makes a comparative analysis through typical cases at home and abroad.In this process,it extracts the experience that can be used for reference by China’s anti-monopoly practice.This paper puts forward comprehensive thoughts and suggestions on the regulation of "Choose One out of Two" in the field of platform economy from the two aspects of anti-monopoly theory and legal regulation,with the intention of providing a feasible path to better regulate the "Choose One out of Two" phenomenon of platforn economy at present and in the future.Finally,this paper creatively puts forward the theoretical reconstruction ideas such as retaining the element of damage effect,as well as the institutional design of anti-monopoly procuratorial public interest litigation,in order to promote the anti-monopoly regulation of "Choose One out of Two" behaviors in the field of platform economy field,and promote the research and development of this subject.
