The construction of villages under the rule of law is the basic work for comprehensively promoting the rule of law and implementing the rural revitalization strategy.Since the "construction of law-based villages" was first put forw ard in the No.1 document of the Central Committee of the Communist Party of China in 2018,all localities responded quickly and formulated a legal village construction plan based on local conditions,which also included the content of the people’s courts.As the most basic unit of the people’s court,the people’s tribunal plays a "bridgehead" role in promoting the modernization of social governance and rural revitalization,and is an important subject to strengthen the construction of grassroots political power and maintain social harmony and stability.Taking the G People’s Tribunal of Nantong located in the economically developed area of Yangtze River Delta as the research sample,this paper analyzes the current situation of its participation in rural grass-roots governance through literature analysis,questionnaire and case study.It summarizes the four main problems of people’s tribunals’ participation in grassroots governance in the background of rural construction under the rule of law:unclear boundary standards,poor social effects,lack of judicial capacity and failure of coordination mechanism.On the basis of this,this paper makes an in-depth analysis of the causes of the problems from four aspects of embedding theory,and draws a conclusion that the reasons for the problems of the people’s tribunal’s participation in grassroots governance are mainly from the four aspects of politics,cognition,culture and structure,which are divorced from the requirements of rural construction under the rule of law.Finally,aiming at the problems of people’s tribunals’ participation in grass-roots governance,this paper explores the improvement path by combining the government constitutionality theory and the embeddedness theory.The article points out that the people’s tribunals should make changes from four aspects:clarifying the direction and scale of participation in rural grassroots governance,accurately positioning the needs of rural construction under the rule of law,embedding judicial capacity into rural social network,and promoting the effective operation of cooperative governance mechanism.
