Research On The Rule Of Law Of State-owned Enterprises’ Participation In Social Governance

China’s state-owned enterprises are an important force in the state regulation of economic and social development,not only to bear the legal economic responsibility,but also to bear the corresponding social responsibility,is an important social subject to promote the modernization of social governance system and governance capacity.Since the founding of New China,state-owned enterprises have gone through several historical stages of participation in social governance.Historical experience and lessons have taught us that the social function of state-owned enterprises cannot be performed without the guarantee role of the rule of law.The rule of law for state-owned enterprises to participate in social governance is to play a fundamental and protective role of the rule of law to consolidate the fundamentals,stabilize expectations and benefit the long term,and use the rule of law to regulate the whole process and all aspects of state-owned enterprises’ participation in social governance behavior.It not only looks at the legal role of state-owned enterprises as social subjects participating in social governance,but also looks at the rule of law needs oriented to the practice of state-owned enterprises participating in social governance,with deep theoretical motives and value implications,and should adhere to the basic principles of Party leadership,combination of rule of law and moral governance,and combination of hard law governance and soft law governance in the process of its development.At present,the rule of law for SOEs to participate in social governance is not perfect,and there are problems in many aspects,such as the distinction between SOEs and other enterprises in social governance is not clear in the current law,the role of soft law governance in SOEs’ participation in social governance is not yet effective,and the construction of SOEs’ internal legal compliance governance system is not yet complete.The problems should be tackled by clarifying the dialectical relationship between economic and social responsibilities of state-owned enterprises,establishing and improving the soft law governance system for state-owned enterprises to participate in social governance,building a systematic and complete internal legal compliance governance system for state-owned enterprises,and adhering to the Party’s overall leadership of state-owned enterprises to participate in social governance.
