| C2C micro-business transactions are different from traditional e-commerce transactions such as Jingdong and Taobao, and their transactions are based on WeChat social networks as a platform, through the creation of trust between people, using quality or price advantages to provide services or goods to consumers Internet business sales model. With its wide spread, convenient operation and low entry threshold, this model makes the WeChat transaction model more easily accepted by the public than the offline physical store transaction model or the traditional e-commerce transaction model. However,at the same time, due to the fact that micro-commerce is a new type of e-commerce model, the relevant laws and regulations are not perfect, and there is a lack of sound regulatory measures, the development of the industry has been on the edge of the law, which has led to the difficulty of protecting consumers’ right to fair trade, the restriction of the right to know the truth, and the infringement of the right to security in the actual transaction process.According to the current status of micro-business development and current laws and regulations, effective countermeasures and suggestions can be put forward to solve the problem of consumer rights protection under the C2C micro-business model.First of all,at the legislative level,it is necessary to improve the Law on the Protection of Consumer Rights and Interests, the E-commerce Law and other relevant laws and regulations,so as to help us better clarify the legal responsibilities of all parties under micro-business transactions,so that micro-business operators have laws to follow and operate in accordance with the law; From the judicial level, the introduction of online dispute resolution mechanisms can not only broaden the channels for consumer rights protection, but also help reduce consumers’ litigation costs, avoid waste of judicial resources, protect their legitimate rights and interests for consumers, and take into account substantive and procedural fairness. From the perspective of law enforcement,in the process of implementing administrative supervision of micro-businesses,administrative organs should clarify the rights of all parties, clarify boundaries, and protect consumers’ rights and interests from infringement; In addition, the WeChat public platform should also be established and improved to further regulate the trading behavior of micro-businesses.On this basis, the micro-business platform should achieve industry self-discipline and,as a market entity, take the initiative to assume the responsibilities and obligations of operators. At the same time, consumers should also strengthen their legitimate rights and interests as consumers.Through the above countermeasures, the micro-business industry will be diversified and comprehensively governed, and the healthy and orderly development of micro-business will be escorted. |
