Wechat transaction is different from traditional e-commerce transaction.It takes wechat social network as the trading platform and acquaintance relationship as the transaction basis.This transaction mode has the characteristics of convenient operation,fast and efficient,and low entry threshold.Compared with the traditional e-commerce transaction mode or offline entity store transaction mode,wechat transaction is more easily popularized and accepted by the public.As a new e-commerce,the development of this industry is on the edge of law,which makes the legitimate rights and interests of consumers such as the right to security,right to learn the truth,the right to claim,and the right to rescission from the Wechat-business transactions are vulnerable to infringement.The main reasons are as follows: first,the legal supporting measures for the development of wechat-businesses need to be improved;second,there are difficulties in administrative supervision of government departments;third,information asymmetry leads to consumers in a weak position of information;Meanwhile,consumers' psychology and behavior are easy to be affected by unilateral behavior of operators,so it is difficult to make reasonable purchase decision-making behavior;fourth,The imperfection of the judicial relief mechanism leads to the high cost of protecting consumers' rights and the single way to protect their rights and interests,which makes it difficult to get effective relief for their own rights and interests.Based on this,we can put forward effective counter measures and suggestions based on the actual situation of the development of wechat-business and the existing laws and regulations.First of all,at the legislative level,we should check and make up for the deficiencies,improve the "Law for the protection of consumers' interests","E-commerce law","Civil Procedure Law" and other relevant laws,clarify the legal liability of all parties under the wechat-business transaction,and improve the "the cooling-off period of return of goods without reasons" system,reasonable distribution of the burden of proof of the parties,which is reasonable.At the judicial level,online dispute resolution mechanism is introduced to expand the scope of public interest litigation,so as to reduce the cost of consumer litigation,broaden the channels of consumer rights protection,and reasonably allocate judicial resources to provide procedural and substantive justice for consumers' rights protection.At the level of law enforcement,the administrative organs should use the principle of administrative proportion in the process of administrative supervision on wechat-businesses.In order to protect the rights and interests of consumers and maintain the market order,administrative organs must perform their legal duties and define the boundary of power.In addition,the wechat-business operators should realize the self-discipline of the industry,establish operation rules as the market subject.At the same time,consumers should improve their awareness and ability to protect their rights and interests so as to achieve diversified and all-round governance ensure the rights and interests of consumers in wechat-business transactions and the overall development of the micro business industry.
