Research On The Exercise Of Statistical Law Enforcement Discretion In The System Of S Provincial Bureau Of Statistics

Discretionary power in statistical law enforcement is a double-edged sword,which is conducive to statistical law enforcement agencies to optimize law enforcement processes and methods and improve law enforcement efficiency,but may also lead to power abuse and corruption.As a branch of administrative law enforcement,statistical law enforcement has the discretion of law enforcement.As typical street bureaucrats,first-line statistical law enforcement personnel directly deal with the objects of statistical law enforcement inspection.Whether the benchmark of statistical law enforcement discretion is uniform and whether the law enforcement procedures are legal or compliant will affect the rights and interests of the objects of statistical law enforcement inspection.Based on the theory of street officials,this paper investigates the current situation of discretionary exercise of statistical enforcement in the system of statistics bureau of Province S.The paper elaborated the theory of street bureaucrats,statistical law enforcement and the concept of discretion,and listed the advanced experience of exercising discretion in foreign countries,which provided a useful reference for promoting the proper exercise of discretion.At the same time,it introduced the problems existing in the exercise of discretion through interviews.Based on the influence factors of the street bureaucrat theory,this paper makes an in-depth analysis of the specific reasons leading to the problems in the discretionary exercise of statistical enforcement in the system of statistics bureau of Province S.Finally,based on the analysis of the reasons,it puts forward countermeasures and suggestions to promote the proper exercise of discretionary power.This paper shows that there are some problems in the exercise of discretionary power of discretionary exercise of statistical enforcement in the system of statistics bureau of Province S,such as arbitrary law enforcement,selective law enforcement,rigid law enforcement and illegal discretionary procedures.Based on the theory of street bureaucrats,we can analyze law enforcement policy basis,statistical management system,statistical law enforcement inspection objects and statistical law enforcement external environment,and conclude that we can promote the proper exercise of discretionary power from four aspects:ensuring the stability of policy basis,accelerating the modernization of statistical system,strengthening the communication with law enforcement objects and optimizing the external environment of law enforcement.
