Study On The Governance Of Urban Road Occupation Operation

In recent years,with the high quality development of the cities,the contradiction between the urban development goal and the negative impact caused by the mobile street vendors and the out-of-store operation occupying the public space has become increasingly prominent.Road occupation operation emerge repeatedly,and some traditional management methods have been unable to meet the needs of the development of civilized cities.This paper takes the governance of urban road occupation operation as the research object,based on the the actual situation of J district of Taiyuan,by researching field visits,looking up file Information and reading literature,investigates the situation of road occupation operation in the J district,the view on the governance of urban road occupation operation of citizens,vendors and law enforcement officials and the existing management measures and so on,analyzes the problems and reasons of the governance of urban road occupation operation in the J district,finally,explores five governance measures.This paper has six parts.The first part is the introduction,mainly introduces the research background of the paper,the theoretical and practical significance of the paper,domestic and foreign researches on the governance of road occupation operation,research methods and the innovation of the paper.The second part introduces the related concepts of the governance of road occupation operation,including road occupation operation,mobile vendor and urban governance,and expounds three theoretical bases of this paper,city exclude socialism explains why to governance road occupation operation,fuzzy control theory explains the present situation of the governance,the new public management theory provides a train of thought to solve the road occupation operation chaos.The third part briefly summarizes the basic situation of J district of Taiyuan city,which mainly introduces the small streets and lanes and the situation of permanent residents in J district,and studies and analyzes the situation of road occupation operation in J district of Taiyuan,It also makes a systematic and detailed analysis of the current situation of road occupation operation in J district,which includes the measures,effects and trends of the governance of road occupation operation.The fourth part introduces the problems existing in the governance of road occupation operation in J district:the public lacks correct understanding of the governance of road occupation operation and does not cooperate with the governance;the legal identity is unknown and governance basis is limited;the law enforcement method is single,the law enforcement efficiency is insufficient;the Regulatory power is limited,the supervision and management is not fine;road occupation operation emerge repeatedly and traps in a rebound cycle.The fifth part analyzes the causes of problems of the governance of road occupation operation: the lack of publicity and guidance,the limitation of public participation,the weakness of the legal system construction foundation,the inadequacy of the legal guarantee,the need to adjust the old ideas,the lack of scientific supervision and management,the weakness of the law enforcement team construction,the low efficiency of the comprehensive governance,the fast development of the cities and the prominent contradiction of demands.The sixth part identifies the root causes of the governance of road occupation operation problems based on its own reality,and puts forward five suggestions: publicize extensively to build consensus and guide the whole people to participate,improve the system of laws and regulations to lay a solid foundation for the rule of law,strengthen the construction of service-oriented urban management and strengthen supervision and management,advocate the multi-agent element to participate in the coordination and constructs the co-governance pattern,focus on people’s livelihood and urban construction.This paper tries to provide some suggestions for the problems of road occupation operation through the above measures.
