Study On The System Of Imprisonment And Execution Of Felony Juvenile Delinquents

Juvenile delinquency is a common problem that needs urgent attention around the world.With the recent 40 years of juvenile justice in China,the system of conditional non-prosecution,community correction,application of probation,supervision and education has been constantly developed and perfected,and the number and proportion of juveniles sentenced to imprisonment for crimes have decreased year by year.However,due to the objective existence of serious criminal cases involving juveniles,imprisonment is still necessary for some juveniles whose crimes are serious,dangerous and have bad social influence.Juvenile delinquents have the characteristics of incomplete physical and mental development and strong plasticity in reform.Our country adheres to the principle of "education,reform and rescue" and the principle of "education first and punishment second" to juvenile delinquents.We should punish felony juvenile delinquents through compulsory measures of imprisonment,crack down on illegal crimes,ensure social stability and maintain judicial dignity.Moreover,it is necessary to prevent the excessive restriction of the rights of juvenile felonies by imprisonment and punishment,give full play to the reform function of penalty,encourage juvenile felonies to confess their guilt,repent and reform themselves,and promote their early return to society,becoming law-abiding citizens and not committing crimes again.At present,there are the following problems in the imprisonment and execution of felony juvenile delinquents in G Province: First,the laws and regulations are broad and the content is not targeted;Second,there are many disadvantages in the closed execution of imprisonment;Third,the execution function of the execution institute has a certain deviation;Fourth,the basic system of execution is highly "adult";Fifth,commutation,parole leniency standard is not clear.After analyzing the reasons of the above problems,the author puts forward four countermeasures and suggestions to improve the system of imprisonment and execution of minor felony offenders: one is to improve the legal system of execution of minor felony offenders;The second is to optimize the socialized execution of minor felony offenders and the working mechanism of social help and education;The third is to realize the unitary execution function;Fourthly,implement the basic system of execution more in line with the characteristics of juvenile delinquents;Fifth,we will improve the application of the commutation and parole system for minor felonies.In order to encourage felony juvenile delinquents to confess their guilt,repent,practical reform,improve the effect of felony juvenile imprisonment and execution,promote felony juvenile delinquents to return to society,law-abiding citizens,reduce and prevent felony juvenile delinquents to re-commit crimes after release,highlight legal justice,achieve the purpose of punishment,and maintain social stability.
