On The Establishment And Application Of The Life Imprisonment System In China

Our country in the criminal law amendment(nine),first proposed the concept of life imprisonment,and refined in subsequent judicial interpretation.Besides the origin and history of the principle of life imprisonment,the theoretical value of the system and the application of attention caused by the principle of human rights dispute and other scholars problems to clarify,to process the system in our country,the application of the system analysis of the value of theory and practice,and the problems encountered in the judicial practice of the system for long-term practice abroad,on how to better use of the system.The author put forward their own views for the system advice Mainly for the death penalty reprieve,life imprisonment and the concept of distinction and system integration and refinement of life imprisonment system in our country,the procedural provisions and the expansion of the scope of the system,create a new perspective transformation model of labor education punishment,perfecting the life imprisonment system,and learn to use effective system abroad through the refinement and integration,a series of solutions,put forward their own opinions on perfecting the system of life imprisonment,the life imprisonment system in practice,can better be effective use by judicial organs,the road of the rule of law in our country and the protection of human rights more perfect.
