On The Alternative Of A Sentence Of Imprisonment

The first part of this paper tries to begin with the development of the criminal penalty and discover the deficiencies of imprisonment. The second part tries to find an effiective alternative from three measures, including decriminalization, non-penalty and non-durance. First, from the notion of cime, to decriminalize the crime without victim and the slight crime. Second, from the notion of penalty, to keep some crimes whose plot and damage are not very serious from penalty. Third, for the problem of execution, to execute some criminals whose dangers are not serious out of the prison, thus make the imprisonment the last resort and take advantage of the prsion to educate and change the criminal who needs it. The third part of this paper tries to discuss the localization of the decriminalization, non-penalty and non-durance experience in foreign country and the status of this alternatives in the criminal penalty system of China.
