Research On The Basic Problems Of Life Imprisonment System In China

Life in prison system has an important position in the penal system,as China's criminal law amendment(nine)prescribed in the penal system a new penalty enforcement measures,has the vital significance in the construction of the rule of law in our country.The two kinds of punishment of life imprisonment and death penalty has always been a controversial issue,especially in the case of more crimes in China's criminal law.This article mainly discusses the interrelation between death penalty,life imprisonment and life imprisonment.With the application of the death penalty in the criminal law of China more and more cautious,the amendment of the criminal law will greatly reduce the death penalty,and the introduction of the life imprisonment system is of great significance.This paper based on the existing system of life in prison in China,to make clear the property of life imprisonment is a kind of punishment execution measures rather than new mitigation,it is in essence the death penalty suspended execution measures rather than a kind of life imprisonment execution measures also more than one alternative measures of the death penalty.It also give a crude proposal to construct a complete penal system for that system of life imprisonment,with a more normative application of such penalty.
