From the implementation of the dual one-two-child policy in November 2011 to the implementation of the three-child policy in May 2021,it shows that my country has shifted from a family planning policy to a comprehensive policy of encouraging birth,but in recent years,the fertility rate has not been increased as expected.Under the policy of encouraging childbearing,due to the lack of a supporting mechanism for the protection of the rights and interests of women of childbearing age in the workplace,employers often restrict childbearing as a prerequisite for women to enter the workplace,and women’s equal employment rights are violated.The low level of the insurance system has brought many problems to the protection of the rights and interests of women of childbearing age in the workplace.Issues such as employment and medical care will not only put pressure on women’s personal survival,but also affect the implementation of policies to encourage childbearing,which is not conducive to the improvement of the status of women of childbearing age in the workplace and the future development of the country.We urgently need to carry out research and propose solutions.The paper first expounds the concepts and theories related to this article through the literature review method,and then takes Y city as an example to sort out the existing measures to encourage the protection of the rights and interests of women of childbearing age in the workplace under the fertility policy.Using the questionnaire survey method,the actual situation of the protection of the rights and interests of women of childbearing age in the workplace in Y city was investigated from the aspects of the basic situation of the surveyed,fertility status and willingness,employment and job promotion,maternity leave and maternity allowance payment.Through analysis,it is found that there are many problems in the protection of the rights and interests of women of childbearing age in the workplace in Y City.Women are severely discriminated against in employment,and women’s "third-stage" reproductive rights and interests are not fully guaranteed.Further exploration of the reasons is mainly due to the imperfect legal system and lack of employers.social responsibility,etc.Finally,suggestions are put forward to improve the protection of the rights and interests of women of childbearing age in the workplace from the two aspects of the state and the employer,so as to protect the legitimate rights and interests of women of childbearing age in the workplace and promote the full implementation of the policy of encouraging childbearing.
