Research On Comprehensive Administrative Law Enforcement In Townships

There has been a long-term problem in grassroots law enforcement that“what you can see can’t be controlled,and what you can manage can’t be seen”,and the original township law enforcement model can no longer meet the needs of grassroots law enforcement.At present,the implementation of comprehensive administrative law enforcement reform in townships has begun to take shape.The township government has set up comprehensive administrative law enforcement agencies to uniformly exercise comprehensive law enforcement powers.However,there are still some practical problems in the actual operation process.First of all,there is no clear upper legal basis for the establishment of comprehensive administrative law enforcement agencies by township governments.Secondly,although the "Administrative Punishment Law" grants the township government some administrative punishment powers,the existing empowerment provisions cannot meet the needs of the township’s comprehensive administrative law enforcement.Third,due to the lack of corresponding institutional guarantees at the grassroots level,the law enforcement power of county-level functional departments has not been in place.Finally,the township comprehensive administrative law enforcement agency integrates the law enforcement power of the functional departments of the county-level government.For a new law enforcement department to exercise the law enforcement power,according to the relevant provisions of the "Administrative Reconsideration Law",it is necessary to reorganize the reconsideration and supervision of the township comprehensive administrative law enforcement.To correctly solve the above-mentioned problems in the process of comprehensive administrative law enforcement in townships,on the one hand,the township government should ensure its independence when setting up comprehensive administrative law enforcement agencies to prevent interference from other administrative agencies;Grasp the needs of empowerment,and establish a guarantee mechanism to ensure that the decentralized law enforcement authority meets the needs of comprehensive administrative law enforcement.The holistic governance theory requires the integration of government departments,streamlining the organization,focusing on the internal construction of the township comprehensive administrative law enforcement agency,and clarifying the legal status of the township comprehensive administrative law enforcement agency.While integrating departments,it pays attention to the sorting and distribution of law enforcement resources,and by promoting the sinking of law enforcement resources of county-level functional departments,it provides a basic guarantee for the construction of comprehensive law enforcement teams in townships.In addition,due to the limited level of law enforcement in townships,at this stage,the regulations on the exercise of administrative punishment powers by township governments are refined,and powers such as administrative coercive measures and administrative inspection powers are given to township governments to meet the needs of township law enforcement.In order to ensure the impartiality of comprehensive administrative law enforcement in townships and in compliance with the“Administrative Reconsideration Law” on the lowest-level reconsideration acceptance agency,the county-level government is clearly defined as the reconsideration agency for comprehensive administrative law enforcement in townships and towns,giving full play to its effective supervisory role.All in all,it is of great significance to correctly grasp the law enforcement power of townships,the construction of comprehensive law enforcement teams,and the follow-up reconsideration supervision mechanism for the orderly advancement of the reform of comprehensive administrative law enforcement in townships.
