Facial recognition technology has been widely valued by society since its inception,and nowadays various information processors are applying this cutting-edge biometric technology to various aspects of society,making it serve various fields such as payment,security and government affairs.However,while technology brings us convenience,it also gives rise to the legal risk of infringement of relevant personal information.Facing the legal risks of illegal collection,technical abuse and data leakage in the application of face recognition technology,China has issued a judicial interpretation specifically for face recognition technology after the provisions related to personal information in the Personal Rights Part of the Civil Code,and the implementation of the Personal Information Protection Law is also of great significance to the legal regulation of such risks.On the whole,the relevant legal regulation has been relatively perfect,but since the Personal Information Protection Law and other major relevant laws and interpretations have just been introduced and implemented in recent years or even in2021,there is still a need for interpretation of the application of the relevant laws,and there is still room for improvement of the provisions of the relevant legal articles.This paper compares and compares the current situation of legal regulation of face recognition information at home and abroad,analyzes and deconstructs typical cases at home and abroad,explores the specific legal response to the application of face recognition technology,and takes the current law as the basis,the excellent foreign legislation as the reference,and combines the specific situation of cases in judicial practice,takes the Personal Information Protection Law as the basic legal framework,and proposes a clear legal and judicial perspective to We propose to improve the concept,determine the rules and encourage public interest litigation.We aim to provide feasible research results for judicial practice from the theoretical level and create a better legal response environment for face recognition information protection. |
