Abstract/Summary:
With the continuous improvement of science and technology,face recognition technology has developed rapidly in the fields of transportation,finance,security,identity verification,education,medical care,and crowd monitoring.While this technology brings many conveniences to people’s lives,because of its non-contact characteristics,it can collect citizen information remotely,which in turn raises concerns about technological security,personal data leakage,and even privacy violations.Therefore,we need to be cautious when using this technology.Regarding the protection of personal information,the laws of our country are mostly in principle clauses,focusing on the use of information and neglecting the protection.At the legal level,it has not been able to effectively regulate the application boundary of face recognition technology,which has led to an increase in the possibility of personal information being illegally collected,abused,and leaked.Both the face recognition technology itself and the personal information collected are unique,and the protection of personal information will be at risk during the application of the technology.Therefore,it is necessary to clarify the legal boundaries of the use of face recognition technology.In addition,the imbalance between the development of face recognition technology and the protection of personal information needs to be solved urgently,and the relationship between the two needs to be properly handled.Therefore,in the top-level design of the legal system and the design of face recognition technology,it is necessary to grasp the boundary between technological development and the protection of civil rights.This article consists of four parts: The first part is an overview of personal information protection in the application of face recognition technology.A preliminary explanation of the concept of face recognition information,the difference between personal information rights and privacy rights,and the difference between face recognition information and general personal information protection.Second,analyze the risks of personal information leakage and abuse caused the use of face recognition on personal information,and the adverse consequences such as challenges to the traditional informed consent protection system.The second part,mainly from the legal boundary of the application of facial recognition technology,clarifies whether the application of facial recognition technology should be used in what scope is legal and legitimate,and the application of facial recognition technology should follow the principle of proportionality when collecting personal information.The technology should be applied within the scope of legal standards and determine the boundaries of legal liability of all parties.The third part,the use of face recognition technology should follow the rules of informed consent.First,the improvement of the effectiveness of the terms of collecting personal information by face recognition technology needs to be achieved through the establishment of a highstandard informed consent rule system.Transparency of the rules governing the processing of personal information by face recognition.Strictly control the collection of personal information,restrict the application of general consent rules,and build a dynamic consent rule protection model.The fourth part is to divide the different levels of personal information in the application of face recognition technology by dividing the types of face recognition information,and to protect the different levels of personal information in layers to avoid a one-size-fits-all approach.Strengthen the improvement and standardization of the legal system,and form a hierarchical protection system for face recognition and personal information.
